Friend now in LTC and we're contemplating marriage, divorce, and all that
Ontario
A friend had a TBI and is now in an LTC for the rest of his life. It got the rest of us in the friend group pondering futures and what our best routes might be. Someone's parents told us that in Florida, it's better to get divorced as then the spouse in LTC qualifies for government funding. But that's there.
Our friend was a mechanic, so no pension, and receives ODSP until he turns 65. ODSP cofunds his semi-private LTC room.
1 assuming spouse is still working, what financial hit are they going to take (other than having to single handedly now pay bills, mortgage, etc). What is their obligation to LTC?
2 assuming long marriage. If the outside spouse has a pension and benefits, does this change anything? Is the spouse in ltc with no pension still entitled to odsp or gis? Does pensioned able spouse have to give part of income to pay for ltc spouse?
3 assuming short marriage and ltc spouse is not entitled to part of that pension and has no pension ? They still get odsp or gis? What is able-bodied spouse's financial obligation?
4 ltc person meets person (working or with pension) after injury and they marry? Do they now have legal obligations to finance the LTC care?
Does divorce help in situations 1-3?
