Typical for instructor to refuse SIAR and what options?

My kid made a mistake and turned in a creative project to two classes. He wasn't thinking and created one work that had specific parameters and then turned the same thing in to a similar class that just wanted "something you love." He did love what he created and simply wasn't thinking. I'm fuzzy on whether he told Instructor 1 - the one he actually created the work for - that he turned it in for both classes or somehow Instructor 1 found out, but he did admit it and begged for mercy. None was forthcoming. Fair enough, but Instructor 1 also said many demeaning things to my kid and ostracized him for the remaining weeks left.

Upon receiving notice from the administration, he realized he qualified for and so submitted the form for SIAR, the Student Instructor Alternative Resolution, by admitting his guilt.

But, at his initial meeting to resolve the case, he was told SIAR isn't an alternative because Instructor 1 wouldn't agree to it. This seems to kick in many other issues, including receiving a written warning and one semester probation and, importantly, lowering by one letter grade not just in Instructor 1's class but also the other class. Instructor 2 in the other class didn't seem to have a problem with it when my son told him. Instructor 2 has submitted the grade, Instructor 1 has not.

Is it typical that instructors won't agree to SIAR or is this instructor an outlier? I'm trying to figure out how to help my son. He is P/F in the class with Instructor 1 who said demeaning things, so does this mean Instructor 1 can fail him? My son certainly feels that is the instructor's intent even though a letter grade lower should mean a passing grade. Are there any campus resources that could provide support or is it up to the parent to find an advocate and if so, who? TIA.
