Cycling accident on bike path due to potholes, can I claim compensation?

I had a cycling accident on the bike path along Point Nepean Road near St Johns Wood Road Beach (Mornington Peninsula) caused by potholes on the bike road. The potholes were large, deep, and numerous, covering the whole of the bike path surface. I have photos and documentation of the hazard.

My situation: • Bike path on a state road, unsure if VicRoads or Mornington Peninsula Shire is responsible for maintenance • Only have RACV roadside assistance insurance, no personal injury cover • Damage: rear Ultegra Di2 derailleur snapped, rear tyre punctured, and left shifter scratched

My questions:

  1. Who do I submit the claim to – VicRoads or the Shire?
  2. Does TAC apply at all here, or only for motor vehicle accidents?
  3. Are there time limits I need to be aware of?
  4. Can I claim for property damage (bike parts) even without personal injury cover?
