Mechanic put non-Honda differential fluid but told me he put the right stuff in.

A few months ago I had an emergency come up and I needed to drive long distance. My 2024 AWD hybrid SL was already at 5% left on the oil life. I called Honda to book a service including the differential fluid change. They told me they couldn't fit me in for a couple weeks. I had to go to a non-Honda but reputable mechanic for the service. I asked him about the rear differential fluid change. He said no problem.

They did the work, gave me a parts and labor sheet that says they used Honda DPSF-II 1.32 Qts.

A drove about 1500 miles. A couple months go by and I start hearing a slight shuddering noise. A few weeks go by and it gets worse.

I took it back to the mechanic and he said everything looked fine but I might want to go to Honda because maybe they have a recall. sus

A couple weeks later (today) Honda tells me they drained the fluid, it is defintely the wrong kind of fluid meant for single-pump differential. There are metal shavings in the fluid.

They drained and refilled it three times. $800. It's driving again, but they don't know if there is permanent damage. A differential replacement is around $4k - not warranty covered.

I'm wondering if I have a small claims case against the mechanic? I have the receipt that says they put the right fluid in. I have a bottle of the fluid drained from the car for testing.

What do you think? Am I screwed or do I have a case?
