Sharing from a long journey after receiving my preavviso di rigetto. I just received an email of recognition. To summarize my prior post, I was part of the SF December cohort and received my preavviso in June because of the minor issue only. I will cross my fingers many of you will have success soon! Many thanks to u/chinacatlady and Guillermo Iso from ViaMonde who provided exceptional support in helping my family!

SF - December group (minor children, minor issue) Received Preavviso di Rigetto

Hello,

I just received the 10 day pre-notice rejection in the mail today 😞 My application includes my two young children and I have the minor issue (GM born 1913, her father naturalized 1921). I'm seeking guidance on how to effectively respond to the pre-notice of rejection. Does anyone have any advice on how best to respond to the consulate given the unfortunate situation? I know others grandfathered in with the minor issue have been accepted in the same December group). I would appreciate any help or guidance on this!

Here's the translated version:

HAVING REGARD TO Law 05/02/1992, n. 91 and all legislation on Italian citizenship;

HAVING REGARD TO the application for recognition of Italian citizenship by descent, submitted to this Consulate General of Italy on 12/23/2025, by [Me]

CONSIDERING that the Italian ancestor from whom he claims descent, [LIRA], born in Corleone on 08/01/1877, naturalized as a U.S. citizen on 03/26/1921;

CONSIDERING that the daughter, [GM], born in NY on 12/18/1913, was a minor at the time of her father's naturalization;

CONSIDERING the new interpretive guidelines on citizenship by descent dictated by the circular of October 3, 2024 n. 43347 of the Ministry of the Interior and which introduce certain recent rulings of the Supreme Court of Cassation (Cass. Civ. Sec. I, ord. N. 454/2024 and n. 17161/2023);

CONSIDERING that according to the new orientation of the Cassation Court, the Italian citizen who — under the 1912 law (and, even earlier, the civil code of 1865) — lost Italian citizenship as a consequence of the voluntary acquisition of foreign nationality, also caused the loss of our status civitatis to the minor child living with him, even in the case where the child was born in the United States, where jus soli applies;

CONSIDERING that the citizenship transmission line must be considered interrupted, the minor in question no longer having, from the date of the parent's naturalization, the capacity to in turn transmit citizenship to her eventual descendants.
