Separate ISTA charge by Independent

So my 2014 328d is blowing oxygen sensor codes again and the dealer blamed on a poorly designed DPF that BMW has since redesigned . Took it to my normal Euro independent shop for second opinion and they confirmed the diagnosis. My surprise is there estimate to fix was only 200 cheaper from the dealer. Primarily caused by a ISTA programming software charge that essentially offsets there cheaper per hour labor charge. The separate charge was 379 on top of the labor charge. Are any other independent charging this separately to recoup there ISTA cost? I am in eastern Pennsylvania.
