Not in a Resident in a Drug-Free Residential Facility - Denied SDI Claim

Hi,

I've been having problems with my SDI claim. I am wondering if anyone has been in the same boat as me. I was denied based on 2626.1 of the California Unemployment Insurance Code, which states that I was not a resident in a drug free residential facility.

I did not go into a residential rehab before signing up for IOP. I just went straight to IOP for my drug issue. From my understanding you can get SDI for being at an IOP, as it is a Partial Hospitalization Program.

My question is has anyone gotten SDI for solely being in an IOP program? There are people at my program who are currently collecting SDI no problem. But the EDD is saying my IOP isn't certified/licensed, which is blatantly wrong.

I tried searching but I couldn't find anything on this exact topic, so if anyone has dealt with this before I'd love to hear from you.

Thanks.
