Crash Advice UK

Hi,

I had a car accident about 4 months ago, where the person who crashed into me accepted 100% liability at the scene and to his/ my insurance company.

Everything went well and I was paid out in full for the write off of my car.

However, last week, I received a email from my insurance company saying that his insurance company has switched liability, denying his fault and putting me down as the reason for the crash.

What happened:

I was travelling down a long road, heading towards a cross road. My light was green and I was fully established within my lane, travelling approx 25/30 MPH; proceeding straight.

The other person was approaching the cross road, he was turning (his right) from the opposite direction, so therefore he would need to cross my lane to get to where he’s going. I was fully visible, being a quiet road with only myself going down my lane. As I was coming up towards the cross road, I saw him approaching the middle of the junction, preparing to turn. I assumed he saw me since I was very evidently visible so I progressed with caution. Just as I went past my solid white traffic light lines, I noticed that he wasn’t going to stop, and at the very last second he accelerated in hopes to get across before I arrived. In the moment he accelerated, it caused me to hit his car at what seemingly seems like a head on direction.

From the impact, his car went rolling down at an angle towards his side of the roads pavement and mine was stuck stationary in the middle of the cross road.

Both are fine and uninjured.

He was clear that he made the mistake in person and owned up to it with his insurance company which is why it was such an easy and swift process, until now.

I have a Dashcam recording of the scene. However, I know this sounds really suspicious, but the Dashcam cut off 2 seconds prior to the collision. I checked online and it could have possibly been a restart since Dashcams record in intervals and I was just unlucky for it to be the time it restarts. However, on the very last frame of the recording, you can somewhat see my car swerve out of the way in an act of dodging his moving car.

I want your guys suggestions on it. Should i provide the Dashcam? Would it be beneficial to?

I have attached the video, images of the crash and a layout of what it looks like.

Please give me your honest suggestions.

Hi,

I had a car crash in February, about 4 months ago where the person who went into me admitted 100% liability.

The road was a cross road. The lights were green and I was proceeding straight. The person who went into me was turning (his right) from straight ahead. This automatically means I have right of way since I am already established within my lane.

Yesterday, I got a email from my insurance company, informing me that the other persons insurance company are trying to change liability. They are stating that he was stationary on the cross road and that I went into him. This is not the case. This means that the whole claim is going to be reviewed by an independent adjuster.

I have photos of the scene which shows damage to his car and my car. Because of the layout of the cross road, which faces cars more at a head on direction rather than at an angle, it looks as if I have had a head on crash with him. Though that’s possible, it was due to his negligence and by proceeding out his lane and coming into mine.

He called a day later begging me to do this without insurance involved. I was considering doing it like this on the scene, however he wanted to do it the insurance route. This further proves my point of his 100% admittance, though I don’t have the call recorded.

I have a dashcam which shows me travelling towards the scene and about 2 seconds before the crash, the footage was cut. I know this sounds extremely suspicious and I am really annoyed by the dashcam cutting off for no reason whatsoever just before the main critical part happens. This could have saved all of this since it would be clear evidence of him accelerating. However, on the very last single frame of the video, you can see my car have a sharp turn left, in an attempt to avoid him making his way over to my lane.

I was wondering if people can give their thoughts and opinions on this.

Would it be beneficial to provide my dash cam considering an important part of it was lost? But show them the last frame?

Despite him admitting 100% liability in the past, can it really change that easily?
