Selling land - is a 100% white transaction possible?

I am selling a piece of land and the actual market rate is higher than the government market rate. My agent is suggesting to deal in black and that this is how things work.

He said that the sale agreement will reflect the government market rate and the rest of the amount will be given to us either as cash or as a personal cheque. I am not comfortable with both these options and want to keep it completely transparent and reflect the actual sale amount in the sale agreement.

Can anyone who has recently done any real estate transaction please let me know the process. I just want to know how things work and that there is hope for a full white transaction. Thank you.

How do I find the actual market value of my land before selling? [Visakhapatnam]

Possible encroachment on my land, need advice on how to proceed

Hi everyone,

I own a vacant plot in Visakhapatnam, Andhra Pradesh. A relative recently visited the property and noticed that some construction has started in the neighbouring plot. It appears that a compound wall (or part of the construction) may have been built inside my land.

At the moment, I am not 100% sure if this is the case. My plan is to measure the plot dimensions carefully and compare them with my registered sale deed & survey number. If the measurements confirm that part of the wall is indeed on my land, I would like to know the proper legal process.

I have a few questions:

  1. What should be my very first step after confirming the encroachment?
  2. Should I first get an official government survey done? If yes, which department should I approach in Visakhapatnam (Village Secretariat, Tehsildar/MRO, Survey Department, etc.)?
  3. Should I avoid confronting the neighbour until I have the official survey report?
  4. Is it advisable to hire a property lawyer immediately, or only after the survey?
  5. If the other party refuses to remove the encroachment, what is the usual legal process in Andhra Pradesh? If that is the case, how long do these processes usually take?
  6. Has anyone in Visakhapatnam gone through a similar situation? What worked, and what mistakes should I avoid?

I have all the property documents and will also take photographs, videos, and measurements before taking any action.

Any advice from lawyers or people who have dealt with land encroachment situations in AP or Visakhapatnam would be greatly appreciated.
