Do Philippine Labor Laws Protect Remote Workers Hired by Foreign Agencies?

Hi everyone. I'd like to ask about how Philippine labor laws generally apply in situations involving remote workers hired through foreign agencies.

For context, I work remotely for a client through an agency that serves as the intermediary. The agency handles my employment and payroll, while I perform the actual work for the client.

From what I understand, the agency does not appear to be registered in the Philippines. We also do not receive government-mandated benefits such as SSS, PhilHealth, or Pag-IBIG contributions, and taxes are not withheld. The arrangement initially started as freelance work but later became full-time. I'm also a fresh graduate and have not yet registered as self-employed or begun filing my own taxes.

One aspect of the employment contract caught my attention. It essentially states that the company may terminate an employee at any time and for any reason, similar to how an employee may resign at any time. I'm intentionally paraphrasing rather than quoting it directly.

I've also heard of instances where workers under the same agency were reportedly informed during a phone or video call that they were being terminated effective immediately, without any written notice, explanation, or documented process. There have also been claims that deductions were made from final pay for alleged "damages," but without any clear breakdown or supporting documentation.

With that context, I'm interested in understanding the legal principles for my specific situation.

  • Does Philippine labor law generally apply to remote workers who physically work in the Philippines but are employed through a foreign agency that may not be locally registered?
  • When the employer or agency is based overseas, do Philippine-based remote workers have any practical legal recourse if they believe they were unlawfully terminated?
