I've been telling my sister it's probably mold. She doesn't believe me that it's mold. Who is right?

Got hit by a stupid honda city driver while simply minding my own business on the road. Stopped the dude to check the damage and it hit my side and there was some damage. I didn't want to cause a traffic jam so I took a picture of his car and his phone and thought I'd ask to settle this soon. He admitted it was his fault and was cooperative so I thought it'll be fine.

When I contacted the dude to settle this by paying me he simply said go through my 3rd party insurance. Now I've been through the whole 3rd party insurance debacle before and I don't think I have it in me to do it again unless the damage is huge. He said he is a CA and lawyer and told me to file a suit if I want to settle it.

I regret not asking him for money upfront for the damage. Don't be like me, don't be nice, just get your money and leave!
