This is today's chart. Down from $300.77 (close on 6/22/26) to $135.47 on 7/17/26 - (-54.9%). The price is trying to rally and I still think it might rally to around $190 to $200. But what will happen next?

This chart is from the last peak in 2024 at $68.59 on 7/10/24. The price then fell to $27.89 on 8/5/24 - (-59.4%). The price then rallied to $41.73 +49.6% on 8/21/24. But what happened next?

This chart is from another peak in 2021 at $72.99on 12/27/2021. The price then fell to $36.39 on 1/27/2022 - (-50.18%). The price then rallied to $51.02 +40.3% on 2/9/2022. But what happened next?

So what happened next? Well its not good new bulls.

After the rebounds of 40% (2022) and 49% (2024) the price fell to $6.93 (10/14/2022) and $8.25 (4/8/2025). That's an overall drop of 90.5% (2021/2022) and 87.9% (2024/2025).

History doesn't repeat but it rhymes.

[CA] [TH] HOA charging me for termite *damage repair* CC&Rs say that’s the Association’s job, not mine. Lost at hearing, what now?

The situation

I own a townhouse in a California HOA. Termite damage was found on an exterior patio fence/railing that the Association maintains. The HOA is assessing me for the cost of repairing that damage. I disputed it, requested a hearing, and the board ruled against me. I'm trying to figure out my next move.

What the CC&Rs actually say

Our Declaration has a section dealing specifically with termites. Paraphrasing the key language: the Association is not responsible for the eradication and fumigation of termites, but the Association is responsible to repair any damage caused by termites to exterior areas it's already obligated to maintain. Damage to areas outside the Association's maintenance responsibility falls on the owner.

The way I read it, that splits termite cost into two buckets:

- Eradication / fumigation (killing and treating the termites) -> my responsibility
- Repair of the damage to a maintained exterior surface -> the Association's responsibility

The fence is an exterior surface the Association maintains under a separate section. The bill I'm being charged is entirely for repair, replacing rails, plates, and pickets. None of it is for fumigation. So under the plain text, this looks like the Association's cost, not mine.

The HOA's position

They leaned on a general provision that lets them assess an owner when damage to common area is caused by the owner's negligence or "act or omission," arguing the termites originated from my unit. I pushed back that (a) a specific termite provision should control over a general damage provision, and (b) I have pest-control treatment records showing treatment was completed, which undercuts any negligence claim. The board ruled against me anyway, basically saying I waited too long to get the home termited. It’s been about 4 years since the last fumigation was completed. There is no timeline or statute anywhere that outlines a required timeframe or schedule that a homeowner just stick to for fumigation.

Where I'm stuck

I think I'm right on the documents, but "being right" and "getting the board to reverse" are clearly two different things. For those who've been here:

  1. Has anyone successfully challenged the specific-provision-controls-over-general argument with a board, and how?

  2. What's the realistic next step in CA after losing a hearing — formal IDR, ADR (Civ. Code 5925+), small claims, something else?

  3. If the bill is for repair and the CC&Rs assign repair to the Association, does that change the small-claims calculus at all?

  4. Anything I'm missing about how Davis-Stirling treats this kind of maintenance-vs-owner allocation?

Appreciate any guidance from people who've fought a similar one.
