Government responded to “Review anti-discrimination laws to strengthen trans women & LGBTQ+ protections”

TLDR: Wishy washy word salad

All LGBT+ individuals deserve dignity and protection. We are supporting the community through banning conversion practices, reviewing LGBT+ health services, and strengthening hate crime laws.

This Government is committed to ensuring that every individual is protected from unlawful discrimination and harassment. We acknowledge the concerns raised by this petition regarding the strength and consistency of protections.

The Equality Act 2010 provides a robust framework to outlaw unlawful discrimination, harassment, and victimisation in public services, employment, and housing on the basis of gender reassignment and sexual orientation. We are dedicated to ensuring that these protections are experienced in practice across the UK.

This means ensuring that current laws are clearly explained to duty bearers. Most recently, this Government laid the Equality and Human Rights Commission’s updated Code of Practice for Services, Public Functions and Associations in Parliament, in draft form for Parliament to scrutinise. Parliament did not disapprove the Code. The Code, which came into force on 5th August, includes practical advice to support service providers’ compliance with the law. It also clarifies when it may be necessary and proportionate to provide separate and single-sex services, as well as how providers can adapt their services to meet trans people’s needs. We have always been clear that duty bearers should follow the law as clarified by the For Women Scotland Supreme Court judgment, and seek specialist advice where necessary.

We are also bringing in new protections to target abuse and discrimination in the UK. For example, on 25 June 2026 we introduced a trans-inclusive bill proposing to ban criminal conversion practices. For too long people have been subjected to attempts to change who they are. These practices have no place in modern Britain.

Further, under the recent Crime and Policing Act, the Government has brought in stronger penalties against those who commit crimes against someone based on their disability, sex, sexual orientation, or transgender identity. Such crimes are now considered aggravated offences, and will receive a higher sentence.

Through the Equality Act 2010, public bodies - including the police - are under a duty to have due regard to eliminating discrimination. If individuals feel any reports of hate crime have not been handled appropriately, they are encouraged to escalate a complaint through the Independent Office for Police Conduct (IOPC) via their website.

In employment, we regularly engage with employers to promote best practice when it comes to inclusive hiring and retention. The Employment Rights Act 2025 requires employers to take all reasonable steps to prevent the sexual harassment, and creates an obligation for them to protect employees from third-party harassment.

In education, we have delivered inclusive, age appropriate Relationship, Health and Sex Education statutory guidance. The new guidance strongly encourages primary schools to teach about healthy loving relationships, including same-sex parents. At secondary school, healthy same-sex relationships should be covered. It is only right that our diverse society, with families and people of many identities and backgrounds, is reflected to our children.

We recognise that LGBT+ people experience significant health inequalities. Last year, the Government commissioned NHS England to undertake an LGBT+ health evidence review, led by the NHS’ National Advisor on LGBT+ health, Dr Michael Brady. This review will provide evidence-based recommendations for how we can improve LGBT+ health outcomes. The review will be published later this year.

In housing, local authorities must be mindful of the Equality Act 2010 and their Public Sector Equality Duty towards people who have a protected characteristic. We also know that LGBT+ people are at higher risk than the general population to experience homelessness. Our National Plan to End Homelessness sets out a credible plan to get back on track to ending homelessness, with the strategy driving long-term sustainable change to address the root causes of homelessness, providing support to councils and public services to shift from crisis to prevention, and short-term immediate actions to tackle the worst forms of homelessness, including halving long-term rough sleeping by the end of this Parliament. We are also investing £3.6 billion for homelessness and rough sleeping services from 2026-2029. Local authorities can use this money to respond to local needs and determine the most effective services to support LGBT+ individuals in their area.

If anyone feels that they have been treated unfairly by public services, we encourage them to utilise established complaint mechanisms on the official website of the relevant government department, local council, or NHS trust in question. They may also contact the Equality Advisory Service, whose helpline advises and assists individuals on issues relating to equality and human rights, across England, Scotland and Wales.

A public toilet story..

I want to share an experience with you all.

Today, I popped into a supermarket needing the loo. I went into the ladies, where I was met with a queue. So I waited patiently for a minute, even shared a joke with a lady, a complete stranger waiting ahead of me about the state of the toilets. When it was my turn, I went into the cubicle, sat down, had a wee, got up and headed out, where I washed and dried my hands, and headed out to continue about my day.

Aside from my relief at emptying my bladder, absolutely nothing happened.

Funny thing is, I've been doing this for many many years without issue. Except once recently where a butch cis lady was getting abused for allegedly being trans, who I stood up for. This was since the supreme court ruling.

The EHRC bullshit is unworkable and unenforceable.

Online Safety

Friends.. Please be mindful that any photos of yourself that you post online, especially in a public place like Reddit, that there are haters and trolls who will quickly save your photos to use in their vile transphobic communities. I have seen on many occasions where such photos have been turned into anti-trans memes and distributed. 

Safety first. Once you post a photo of yourself, you lose control of it. it can end up anywhere, and there is nothing you can to about it.

All I'm saying is please be careful and mindful.

Response from Navendu Mishra MP, who has signed EDM240

Thank you for contacting me about the Equality and Human Rights Commission’s (EHRC) updated guidance. After careful consideration of all the correspondence and discussions I have had on this issue, I have signed EDM 240 disapproving the draft guidance that was laid before Parliament on 21 May 2026.

I strongly believe trans people deserve safety, dignity and respect. Everyone should be able to be themselves and live their lives free from harassment, discrimination and abuse and I think it is important to emphasise that neither the Supreme Court judgment, nor the new code, alter the fact that trans people remain a protected group under the Equality Act 2010.

However, I am also aware of the strength of feeling among transgender people and organisations who have raised serious and compelling concerns with me about the updated guidance and how it will work in practice. The overwhelming majority of those who have contacted me are profoundly worried and distressed about its impact on trans inclusion in public life. This concern is widespread and cuts across our community too – having been expressed by transgender and non-transgender people alike, by women and men, by parents of young trans people, and by local organisations in Stockport.

I also recognise serious concerns that the guidance could lead to gender policing, with organisations expected to make judgments based on appearance. Many people fear this could increase the risk of harassment for anyone who does not conform to traditional gender norms, not just trans people.

Given the strength and consistency of these concerns, I believe it is right to reflect them by signing EDM 240.

At the same time, I reject any notion that this Government is not committed to reducing violence against women and girls. In this vein, I echo what the Government has said about the Court judgment and wider debate not being viewed as a triumph of one or more groups in our society at the expense of another. All women and girls, regardless of gender assignment at birth, deserve to be safe and supported, and the Government is prioritising tackling violence against women and girls across education, policing and the criminal justice system.

I also believe that now more than ever, people in positions of authority, such as politicians, must speak out about the importance of our shared values of tolerance, respect and fair-mindedness.

Abuse in a public toilet

I was sat on the loo in the womens toilet this morning in Tesco, when a woman started yelling heavily transphobic abuse at another woman. I mean properly going for it. All the rage and abuse. The poor recipient couldn't get a word in edgeways to defend herself. When I came out of the cubicle, I quickly realised the recipient was rocking the butch look, and was likely cis. I told the abuser to leave her alone, and she turned on me for not supporting her trying to get the woman out. I told her several times she is wrong but she was having none of it. Security arrived, and escorted the abuser out, leaving the 2 of us in total shock. We got chatting, and she was lesbian butch, totally cis. The irony the abuse was aimed at a cis women, then at a trans woman for not siding with her transphobic abuser.

I've never experienced such hostility in a public toilet before.
