Choosing a matrimonial regime in Mauritius. Divorce rates got me thinking, which one would you pick?
Getting married soon. I took out some loans on my own to buy land and build a house, everything's solely in my name. My partner didn't want to be on the loans jointly (didn't want to be stuck with debt if things ever went south), which I get.
Now I'm trying to figure out which matrimonial regime makes sense given how common divorce is here. As I understand it, we have three options:
- Community of goods (default): only what's acquired during the marriage is shared; pre-marriage assets/debts stay personal.
- Separation of goods — everything stays individually owned/liable, before and after marriage.
- Notarial marriage contract — basically separation of goods, but customizable with specific clauses (e.g. compensation after X years, recognition of non-financial contributions, etc).
Since my property predates the marriage, either #1 or #2 should protect it from an automatic split. The real question is what's fairest going forward, for both people.
Anyone here actually navigated this (or been through a divorce) in Mauritius?
- Did a notarial contract feel worth it?
- For "separation of goods", did it hold up in practice, or did courts still award compensation anyway?
- Notary recommendations for a contract that's fair to both sides, not just one?
