my checked baggage was delayed 48 hours on a LOT Polish Airlines flight from Geneva to Thessaloniki through Warsaw in December 2025. The luggage got stuck in Warsaw. I had to buy replacement clothing and toiletries totaling EUR 216 to get through the delay, which unfortunately fell over the Christmas holiday. I kept all receipts and submitted them to LOT as part of a formal claim. In total I got 2 Tshirts, one pair of jeans, 2 sweaters and 2 underwear to cover me for the next two day.

LOT acknowledged liability under the Montreal Convention but is only offering 50% reimbursement, arguing that the clothing I bought "retains future usability" and that some toiletries were non-essential. I pushed back in writing citing Articles 19 and 22 of the Montreal Convention which simply requires that expenses be reasonable and necessary, but they're holding firm. I've escalated to the Polish Aviation Ombudsman, who declined jurisdiction, pointing out that baggage claims fall under the Montreal Convention rather than EC 261/2004, which is all they handle. I checked several for help AIs but they direct me to broken links and to organizations that don't exist.

Has anyone successfully pushed LOT or another airline past this "future usability" argument? Do you know which organization is responsible to dispute it and how to approach them ?
