Bought a lemon used car, need advice
I bought a used Subaru from a registered used car dealer in Mississauga, and it has turned out to be a real problem, and I need advice.
Bought the car in certified condition, *n**ot “*as-is”. It came with a three year warranty from a third party company.
I took the car for a test drive, but was accompanied by an employee of the dealership, very short (6km), went really well.
A week later I put down a deposit, then a week after that I picked the car up.
On the way home, on the highway, there was an issue. There was a whining sound and it felt to like the car was having trouble staying in gear. I stopped and called the dealership and said there was an issue. They said that the timing belt had been changed, and it needed break in time, and it was okay to drive it home.
I drove the car to and from work and the problem got worse, and the car now shuddered when starting from a stop as it accelerated to 60km/h.
I called the dealership, they said take it to a local mechanic (I live more than 100km away, but work closer to the dealership). They said if the problem was minor and the machine could fix it, they’d pay for it. Otherwise, it would have to be towed to the dealership, and did I have CAA?
My local mechanic assessed the car; he found that the transmission was almost empty of fluid, and there were metal shavings in the front differential. He also found that he A/C wasn’t blowing cold air, yesterday was the first time it had been driven in the heat.
My mechanic says that I need to go give the car back and get out from under it.
I have been in possession of the car for 9 days including today. That included a holiday long weekend. It has been driven less than 600km. It has not moved since the transmission issue was discovered.
I emailed the dealership yesterday and their service department together outlining the problems and telling them that I have no confidence in the vehicle, and told them that I wanted to return it. I have not heard back from them.
Can I demand my money back? What are my next steps resolve this if they don’t want to fix the problem?
