Security deposit not being returned
I live in North Carolina, and moved out of my last place on July 15. From what I can tell through Google, landlords have 30 days from the move out date to “return your security deposit or provide an itemized list of deductions,” and if they provide the list of deductions have an additional 30 days. One roommate got his check and a letter outlining what each person was owed on Aug 6, and we received no deductions to our deposit.
I reached out to my landlord and found out he sent my check to an address lacking my apartment number, and my leasing office doesn’t have the letter either. I asked my landlord to send a new check, and he is claiming we should wait the 14 business days for the postal service to deliver (if they are somehow this delayed delivering one city over, and have delivered to my roommates also a city over), and an additional 2 weeks for them to return the letter if it cannot be delivered so we’re sure it’s not on the way.
Am I in a position to demand he send a new check or even threaten legal action yet? I feel like things line up, but I don’t want to make a fool of myself.
