I’ve lived in my Atlanta condo since 2008, and recently received my first HOA violation over visitor parking.

The HOA determined my boyfriend’s car “belongs to a resident” and threatened to tow it, even though he has his own separate residence, and does not live with me.

What’s concerning is there does not appear to have been clear communication, transparency, or consistency around how this determination was made or what standards are being applied.

I formally disputed it in writing, and requested the governing provision, board action, criteria used, and evidence relied upon.

There have apparently been ongoing complaints regarding the vehicle, which is confusing to me because the visitor parking process and parking pass requirements were followed. There also isn’t anything in the governing documents that prohibits how often a guest can use visitor parking.

Has anyone dealt with something similar with an HOA/condo board in Georgia? Also open to recommendations for strong HOA attorneys in the Atlanta area.
