Insurance Trying to Deny Claim After Sending to Preferred Shop

Insurance recently said my claim was under investigation. Found out they’re investigating because they believe the repairs don’t align with the accident details.

I hit a concrete median, burst the tire. No damage to rim but when tire was replaced, mechanic said he suspects it the rear differential has a major issue and recommended I take it to Benz. Took it to the insurance’s shop as they refused to send it to Benz. Told them to check the rear diff, I was dismissed and they said they’ll sort it out during alignment. After they fixed the front bearings, told me to come back 2 weeks later to get the back bearings done. Did that and they found out the rear diff needs replacement. Finally got sent to Benz, they confirmed and sent a 9K quote. Now I’m worried they’re going to try to say I could have damaged the rear diff during the 2 week period these idiots let me drive on it without checking it like I had told them to in the first place. What are the odds this claim

Will be rejected and what is the best way to handle this?

Claim is now under investigation “without prejudice”?

Ontario, CA - I hit a short concrete median swerving for a fox. Initial repairs were covered but for the last component they sent my car to the Benz dealership due to the affiliated shop dragging their feet (fixed front bearings, then back bearings 2 weeks later and discovered rear diff needs to be replaced). The last quote sent to them was 9K. I was supposed to be reimbursed for the tire I got fixed prior to making a claim, which was initially approved but still no payment and that’s prolly under review too. They sent me an email today saying they will proceeding with the claim on a “without prejudice” basis and that they are launching an investigation. They also stated that the rental that was supposed to be covered will be my responsibility until a decision has been made for coverage. What does this mean for my claim and what has made them switch up all of a sudden? I’ve been without my car for almost 3 weeks and the accident happened 30 days ago.

Repair or Payout?

Lengthy post. Hit a short concrete lane median swerving for a fox with my 2020 GLC 300 (still under extended warranty). My personal mechanic who specializes in German Luxury vehicles advised I take it to Benz and suspected bearings and rear diff were affected. Aviva (ON) sent me to their mechanic even though I insisted on sending to Benz. Trusted them and followed their protocol. Long story short it’s now at Benz because the partner mechanic just kept “finding” the issues my mechanic had cited and they dismissed me when I told them to check these exact issues before they even touched it. They said it was fine to drive, fixed the front bearings within 1 week of the accident, 2 weeks later fixed the back, now the finally discovered the rear diff needs replacement. Benz quoted $9K and now it’s under review, I suspect due to the high price. It’s been 30 days since the accident and the body work hasn’t even been started. Spoke to the Adjuster and cited that additional damage related to the fact they let me operate the vehicle with damage for over 3 weeks was likely possible and he agreed and said he’d speak to his superior as I was questioning how that would be covered in the further. Repairs in total

Including the pending 9K would total around 16K and the car’s market value is around 30K. Will they fix this or pay me out? If they pay me out, what are the odds it’ll be more than CMV?
