Senator-judge Erwin Tulfo questioned whether the votes of senator-judges who are not attending the impeachment trial should still be counted in determining the number of votes needed to convict Vice President Sara Duterte.
Four of the 24 senator-judges are currently absent: Sen. Loren Legarda, who is on medical leave; Sen. Ronald “Bato” dela Rosa, who remains in hiding amid an ICC arrest warrant; and Senators Jinggoy Estrada and Rodante Marcoleta, who are detained over separate plunder cases. Under the current ruling, 16 affirmative votes—two-thirds of the 24-member Senate—are required for conviction.
