Litige avec mon ex concernant la vente d'une voiture (abus de confiance, escroquerie?)

En 2022, alors que j’étais, F24, en couple, j’ai accepté d’acheter la voiture de mon partenaire de l’époque pour 20 000 €.

Nous avons tous les deux signé un contrat de vente écrit. Le contrat m’identifie comme l’acheteuse et lui comme le vendeur, décrit la voiture/le modèle et le kilométrage, indique un prix de 20 000 €, et précise également que 2 000 € restaient encore à virer. Malheureusement, aucune date ni aucun numéro de chassis ne figure sur le contrat. Je possède le document original, signé, et sa partie est remplie de sa propre écriture.

D’après mes souvenirs aujourd’hui, je lui ai versé 18 000 € en espèces et les 2 000 € restants devaient être versés ultérieurement. Je suis en train de demander mes anciens relevés bancaires, car je pense avoir retiré cette somme en un seul retrait important en espèces au guichet de la banque à peu près au moment de la transaction.

Il m’a remis la voiture ainsi que le document d’immatriculation original, bien que le véhicule soit resté immatriculé à son nom. (On m’avait assuré qu’il ferait le changement dès le lendemain matin.) Nous avons également tous les deux signé sur le contrat que le véhicule m’avait été remis, ainsi que payé.

Peu de temps après, il a pris la voiture sans mon autorisation alors que nous étions toujours ensemble. Il l’a ensuite vendue à quelqu’un d’autre, ce que je n'ai appris que bien plus tard. Je n’ai jamais récupéré mon argent.

Évidemment, je possède le contrat, bien qu’il soit incomplet comme mentionné précédemment, et j’ai des messages datant de cette époque dans lesquels je l’accusais d’avoir volé ma voiture, et je lui ai envoyé une photographie du contrat. Cela pourrait donc au moins permettre de déterminer plus précisément la période à laquelle le contrat a été établi.

Dans les messages écrits que j’ai toujours en ma possession, il est passé de l’affirmation selon laquelle j’avais falsifié le contrat, à me dire qu’il allait me ramener la voiture, puis à prétendre qu’il m’avait rendu tout mon argent.

J’ai initialement signalé les faits en 2022. Les autorités ont ordonné des investigations policières et j’ai ensuite été entendue de nouveau, mais je n’ai pas correctement poursuivi l’affaire à l’époque parce que le policier m’a convaincue de laisser tomber.

Il y a également eu des violences physiques pendant la relation. Je possède des photographies datées de blessures, des messages menaçants, notamment dans lesquels il me dit qu’il va me frapper, ainsi que d’autres messages très abusifs. Au moins une personne a directement été témoin de violences et accepterait de témoigner. D’autres personnes ont vu mes blessures à l’époque, et je possède une conversation datant des faits avec une autre personne (une amie de lui) concernant un incident dont elle a été témoin.

L’une des raisons pour lesquelles je n’ai pas poursuivi les démarches à l’époque était la peur. Il m’avait menacée de ce qui se passerait si j’allais voir la police.

Mon objectif principal est honnêtement de récupérer les quelque 18 000 € que je lui ai payés. Les conséquences pénales sont secondaires pour moi, même si j’ai toujours très peur de lui.

Le délai de prescription est de 5 ans et celui-ci arriverait à échéance dans environ 5 mois.

Je ne veux pas le laisser tomber comme ça, mais je ne veux pas non plus me mettre en danger sans raison. Est-il possible d’engager des poursuites judiciaires dans cette affaire?

Can I sue my ex-boyfriend? (Fraud, embezzlement in France)

In 2022, while I, F24, was in a relationship, I agreed to buy my then-partner’s car for €20'000.

We both signed a written sales contract. The contract identifies me as the buyer and him as the seller, describes the car/model and mileage, states a price of €20,000, and also states that €2,000 was still to be transferred. There is unfortunately no date or VIN written on the contract. I have the original document, signed, and his part is filled out in his handwriting.

My recollection today is that I paid him €18,000 in cash and the remaining €2,000 were supposed to follow. I am requesting my old bank records because I believe I withdrew the money in one large cash withdrawal at the bank counter around the time of the transaction.

He gave me the car and the original registration document, although the vehicle remained registered in his name. (I was assured he'd change this first thing in the morning) We also both signed on the contract that the vehicle had been handed over to me, as well as paid.

Shortly afterwards, he took the car without my permission while we were still together. He later sold it to someone else. I never received my money back.

Obviously I have the contract, although incomplete as mentioned before, and I have messages from that time in which I accused him of stealing my car, and I sent him a photograph of the contract. So this could at least narrow down the date in which the contract had been made.

Over a longer period of time of me accusing him, he goes from saying that i falsified the contract, to telling me he'll bring the car to me, to then claiming he gave me back all of my money.

I originally reported the matter in 2022. The authorities ordered police enquiries and I was subsequently interviewed further, but I did not properly pursue the matter at the time because the police officer convinced me to drop it.

There was also physical violence during the relationship. I have timestamped photographs of injuries, threatening messages such as him telling me he'll beat me up, and other very abusive messages. At least one person directly witnessed violence and would testify. Other people saw injuries at the time, and I have a contemporaneous conversation with another person concerning an incident she witnessed.

One reason I did not pursue things properly at the time was fear. He had threatened me about what would happen if I went to the police.

My main goal is honestly to recover the approximately €18,000 I paid. Criminal consequences are secondary to me, although i remain very scared of him.

The prescription is 5 years and that would be in ~5 months.
I don't want to let him get away with this but I also don't want to put myself in danger for no reason. Can this be pursued legally?
