Condo Management - Asking for Repair Cost for Unit

I'm very confused and looking for some support from this community. I received this letter from my condo management last week. Seems like I am being asked to pay for damages related to a water leak for a unit below mine, when neither me or my tenant were informed of any sort of ongoing investigation or had even observed any water leak related issues.

Has any one come across an incident like this? what is my recourse and recommended next steps?

Further to the water leak investigation conducted on May 21, 2026, Management is writing to advise that the source of the leak was identified as a loose bathtub spout and overflow assembly within YOUR UNIT.

 As this plumbing fixture serves YOUR UNIT exclusively, responsibility for the repair and resulting damages falls to the unit owner in accordance with the Corporation's Declaration.

 

For your reference, Section 20(b) of the Declaration states:

"The Owner of a Residential Unit shall... be solely responsible for the cost of maintaining and repairing all mechanical, electrical, heating, cooling, refrigeration and plumbing equipment, fixtures and systems... which provide power or any other service exclusively to his Residential Unit."

 In addition, Section 30(b) of the Declaration states:

"Each Owner shall be responsible for all damages to any and all other Units and to the Common Elements, which are caused by the failure of such Owner to so maintain and repair his Unit."

 As a result of this incident, water escaped from YOUR UNIT and caused damage to the unit below. 

The Corporation also incurred costs associated with investigating the source of the leak, including plumbing services and exploratory drywall openings required to locate and address the issue. 

 Accordingly, the plumber's invoice and the handyman invoice associated with the drywall repairs will be charged back to YOUR UNIT

Copies of the invoices will be forwarded to you as soon as they are received by Management.

Should you wish to submit this matter to your insurer, we recommend that you contact your insurance provider directly.
