Can we cancel the agreement of buying
Hello everyone, wonderful buyers and proud sellers,
I really need some advice because we feel extremely unlucky at the moment, and I would truly appreciate your help.
After almost two years of searching, we finally found an apartment and got approval from the bank to purchase it. Since this is our first property purchase, we also hired a buyer advisor to help us through the process.
We signed the purchase agreement, and almost everything has now been completed. It has been around three weeks, and we are scheduled to receive the keys and move in on September 15.
Something shocking happened today
Today, we discovered another apartment listed by a different real estate agent directly opposite ours.
The apartments have a very similar layout and features, but the new apartment is:
14 m² larger
2 bedrooms, while ours has only 1 bedroom
Listed at exactly the same purchase price
The only significant difference is the monthly owner expenses (ejerudgift): approximately DKK 3,000 for the new apartment compared with around DKK 2,000 for ours.
Naturally, we are extremely disappointed and are wondering whether there is any legal possibility of cancelling our purchase.
Our buyer advisor has told us that we cannot cancel because the authorities had to approve the purchase due to my wife's residence/status, and that this approval has already been granted. Therefore, according to him, there is nothing we can do.
However, we would really like to understand this better.
My question
Could someone please explain how the rådgiverforbehold / advokatforbehold works in this situation?
Does the buyer advisor have an obligation to advise us about all possible ways to withdraw from the purchase, if any option is still legally available?
We understand that we may have to pay a penalty or lose some money if we cancel, but before accepting that we are completely stuck, we would really like to know what our actual legal options are.
If anyone has experience with a similar situation in Denmark, we would be very grateful for your advice.
