Pleading the fifth rules
Gonna preface this by saying I am not American. So I know that pleading the fifth is essentially a way for people in court to asset their right to silence to avoid self incrimination. I also know that you can’t just plead the fifth because you can’t be bothered answering questions or hate police.
But how do they determine if the statement would be self incriminating or if someone is just being uncooperative? What safeguards are in place to prevent people from abusing this or to protect people into giving incriminating evidence after pleading?
