Why is this in the app store?

Found this while checking out that new nintendo mobile game

My modded 3ds won't let me select a mii

it won't let me select a mii for any of games, and on some games that need miis for your file selection (like M&S 2016) it makes them unplayable when you first download theme. And I have Miis, my Mii menu works perfectly fine. Any solution to this?
