Maharashtra | Right of way dispute | Lost confidence in our advocate after 6+ months of repeated adjournments. Should we change lawyers?

I'm from Igatpuri, Nashik, Maharashtra. My family is involved in a civil dispute regarding our only access path to the main road.

Around 2014-15, we purchased what we believed was residential land. We later discovered it was classified as agricultural land. At the time of purchase, the seller physically showed us the path connecting our property to the main road. Unfortunately, nothing regarding this access path was mentioned in writing, and we didn't think much of it because we trusted the seller.

Roughly six months later, our neighbours purchased the strip of land through which this path passes. There were a few disputes back then, but nothing escalated, and we continued using the same path openly and continuously for almost 10 years.

Over the last year, the disputes escalated significantly. The neighbours began obstructing our access to the main road and repeatedly harassing my mother. Before filing a case, we tried resolving the issue through the local municipal authorities, but we felt nothing meaningful happened. The neighbours have strong local family/social connections, and we felt that trying to resolve the matter administratively wasn't going anywhere. Because of that, we ultimately filed a civil suit in January 2026. We also filed a police complaint regarding the harassment.

Unfortunately, even after filing the case, the harassment has continued. The constant disputes, repeated court visits, and ongoing uncertainty have taken a serious toll on my mother's mental health.

My concern now is about our advocate.

Initially, he seemed very proactive. However, after we paid his full fees, his attitude changed completely.

Since January:

  • My mother has attended court once or twice almost every month.
  • Every visit involves spending almost the entire day at court, only to receive another date.
  • From our understanding, there has still been no meaningful hearing before the judge.
  • Communication from our advocate has become very poor.
  • He has cut short or disconnected calls when my mother tried discussing important concerns.
  • Whenever we ask about the lack of progress, we don't get clear answers.
  • He works under a well-known senior advocate in Nashik.

Recently, the senior advocate appears to be trying to push the matter towards an out-of-court settlement or mediation rather than moving the case forward before the court.

To be clear, I have no proof that my advocate has acted unethically, but we've completely lost confidence in him. After more than six months, it feels like there has been little to no meaningful progress. We don't feel heard, we don't feel informed about what's happening, and we no longer feel that our concerns are being taken seriously. At this point, it honestly feels like we're fighting this battle on our own while continuing to pay the emotional cost of repeated adjournments.

My questions are:

  1. Is it normal for a civil right-of-way case in Maharashtra to go 6+ months with what appears to be no substantive hearing before the judge?
  2. Are repeated adjournments at this stage common?
  3. Should we consult a completely independent advocate (not connected to our current lawyer's office)?
  4. Can we change advocates even after paying the full fee?
  5. What documents should we obtain (roznama/order sheets, pleadings, etc.) before making that decision?
  6. Is there any way for us to independently verify whether these delays are being caused by the court, the opposite party, or our own advocate?

Any advice from advocates or people who have dealt with similar land disputes in Maharashtra would be greatly appreciated.Property layout sketch for reference
