Administrator Self Payment

For the administrator of an estate in NY probate, I understand the formula for compensation for his/her work but how do you determine the total value of the estate for that payment? Is it the total value of the assets collected or is it the assets minus the debts paid at the end of the process? Thanks.

Order of Payouts

In NYS Probate Court, what is the general order of an administrator pay outs? I know beneficiaries are last at the end of 7 months but is there a set order for court fees, lawyers/accountants, federal/state taxes and medical bills? And when in the process can those things be paid from the estate account? You don't have to wait 7 months, do you?

NYS Probate: Timeline on Unfiled Taxes

I'm executor of my brother's will and in process of gathering necessary documents for probate. Found out he didn't pay his federal and state taxes for a number of years. My question is how many years back do I have to go from his death to file those past taxes. Can't seem to get a clear answer. Thanks.

IRS: Friend or Foe?

I'm executor of my brother's will. Turns out he never paid his federal or state taxes over the past six years. I'm meeting with the IRS tomorrow to discuss the situation. Any chance they would excuse the late fees and penalties on the federal taxes as certainly not my fault & I'm showing good faith by meeting w/them. Or is that fantasy? Any advice on what else I could ask of them at the meeting to minimize the damage? Thanks.

Turnover/Discovery Proceeding

I'm the executor of my deceased mother's estate, replacing my sister who still refuses to hand over documents. As such, forced to file turnover/discovery papers w/Surrogate Court to get the necessary financial info to complete probate.

Two questions: 1) anyone have knowledge of success rate of such an effort? From experience, do people comply w/the court request and hand over the documents. 2) she refuses to provide her current home or work address so will it be impossible to serve her w/the court order? I do have her email & phone number but it's my understanding that the papers have to be served in person.

Thanks for any thoughts on this.

Thorough Probate Investigation

I'm administrator of my deceased mom's will. My two sisters are the other beneficiaries, one who had POA until mom's death. Reason to believe they both took money from the estate and neither is helping me track down credits & debits. I'm in the process of getting bank and credit card statements, tax returns, social security/pension & other important info on my own so not sure need court to request a full accounting at this point. Question is will this give me enough info to thoroughly track what came in & what went out from her account? Any other documents I might need? Don't want to miss anything as my two siblings, unfortunately, cannot be trusted. Thanks.

I'm executor of my mother's will. How do I find where she did her banking and thus, her debits & credits history? My sister, also a beneficiary had POA while Mom was alive, knows but is not sharing as she probably took some liberties w/funds. The bank account is closed I assume. How do I conduct a search to find the account if that's the way to go? Did a search for unclaimed property but that's different.Thanks.
