Was the judge biased? Harassment order contradictions
Facts you should know before I start writing paragraphs
I met my boyfriend four years ago
We had a on and off again relationship that was very toxic he was emotionally mentally verbally abusive and then it became physical at times
I was stupid and married him in May 2026
He wanted me to move into his house that he owned with him me and my daughter which is not his daughter because we’re married and that’s what married people do they move in together
As soon as I end my lease with my apartment I noticed his behavior started changing and he became very controlling even more controlling than he already was like it was just a whole new side of him
Every time I wouldn’t agree with him or comply with his demands he would say hey that’s why you canceled your lease and you’re gonna be homeless now if you don’t listen to me you’re not I’m not gonna let you move in with me and one of the phone conversations we had we were arguing and he threatened me and I threatened him back this was on June 11 I didn’t know that he was recording the conversation
We make up like we always do because I was an idiot and I move in with him on June 20
June 20 through June 26 his abuse escalated on June 26 he actually pushed me down really hard on June 27 I woke up in the morning after talking to a friend and decided that I’m going to leave
Well I learned the hard way you’re not supposed to tell an abuser that you’re leaving them so I told him over the phone while I was at the store that I just need some time to find a place to live like getting an apartment
I come back home and he changed the locks on the door we’re married I just moved into the house the locks are changed and he has his mother there as a witness to something I don’t know what she was trying to witness I thought I was gonna go crazy because he changed the locks that didn’t happen the furthest thing I did was banging on the door really loud that’s it and demand to be let in anyways I called the police
I called the police I told me they cannot do anything because they can’t force their way into the house so I need to go to Court this is a Civil matter
He would not let me get any of my clothing or my child’s clothing out of the house I was persistent though and when one officer left I called the police again and said hey can you really try to help me get my stuff out of the house I just need a bag of clothing for me and my kids so the third time I called the police finally got me in an escort to meet to the house to get some things
That night my husband ended up filing a harassment order against me online since it was a Saturday it could not be signed yet but it was still pending in the system until Monday until a judge signed it
The very next day he invited me back home saying that he restored my access to the door and that it was just a cooling off period And I can come back home but I knew that was a set up because a cooling off period is temporary a harassment order can become permanent he told me that I can come back home and live in the house with my kid if I comply to him that means I have to sleep in the basement and the lower level room I cannot be in the common areas of the house I have to stick to be in the bedroom so I can’t use the living room room the family room and the only time I can use the kitchen is when he is not home with his kids
We are a blended family but we don’t have biological children together
Anyways two weeks past in the hearing goes I’m homeless with my kid by the way and he gets he’s in the house cause he found harassment order I did file an order for protection because he did put his hands on me but because he filed first he gets to stay in the house
We get to the harassment hearing two weeks later and he plays a 15 second clip of the conversation we had where he was threatening me and I was threatening him but he only played the part where I was threatening him I told the judge that I object to the evidence because the whole conversation needs to be heard for context she denied my objection and allow the 15 second clip of me threatening him into evidence
He played Ring cam footage he did like a collage of ring cam footage of evidence him and his Attorney of me coming back to the house with the police knocking on the door trying to get in to get clothing and he labeled that as harassment and the judge allowed that
He lied and said that I was going to F him up if he didn’t let me in the house and the judge allowed that as evidence
I tried to tell the judge that I had a police report showing that this was a Civil lockout and I was only there to get personal clothing and hygiene products for me and my kid because I could no longer access my home she did not allow that police report into evidence
I objected to that evidence because it didn’t show time stamps and he was trying to prove a timeline he lied and said that after I got my clothing the third time I called the police I came back again that night and he made a collage of ring cam clips that didn’t have the date and timestamp on them to collaborate his story but she’s still allowed it
The lockout was completely ignored in the harassment case.
I’m going to appeal this because the evidence that she allowed into this case doesn’t show the context possibly for a re-trial with the evidence that’s already in the case cause you can’t bring new evidence to an appeal but demanding that the full context and the full recordings and the timestamp and dates be provided
She allowed the text messages of him bargaining with me to come back after he file the harassment order into evidence but obviously she didn’t consider it because she still granted him a permanent harassment order against me
And look at the timeline we got married in May
The conversation of me and him threatening each other was June 11
He still let me move in despite that conversation on June 20
June 26 he physically assaulted me
June 27 he locks me out of the house
The judge did order my order for protection at the same time and they had our hearings back to back but she denied my motion for exclusive possession of the home temporarily until I find a place to live because I only lived in the house for seven days
Do you think I can appeal this and possibly what I know appeals are hard but it’s worth a try
