Red Eagle Law is looking for a plaintiff for an upcoming lawsuit seeking to require the U.S. Department of State (DOS) to open the DV-2027 entry period.

Requirements:

Must be lawfully present in the United States
Must be willing and eligible to enter the DV-2027 lottery
F-1 or H-1B status is preferred, but any lawful presence may qualify
No legal fees

Currently no attorneys have taken a step forward towards DV 2027 except for Red eagle law.

Time is ticking.

The lawsuits for Dv 2026 are nearing judgement and hopefully it will resume DV 2027 too.

I’m a physician and I’m trying to decide whether I should file for EB-2 NIW now or wait and improve my profile.

Education: MBBS + MD in Radiology
Specialty: Radiology
Publications: 4 total
First-author publications: 1
Total citations: 3
First-author paper citations: 1
Other publications: Second- and third-author papers
Conference presentations: 2 peer-reviewed abstract presentations. Top-tier U.S. conferences in my relevant specialty
U.S. association: Remotely associated with a U.S.-based artificial intelligence in radiology organization/entity
Recommendation letters: I may be able to obtain letters from people at this U.S.-based entity
Independent recommendation letters: Also possible to arrange

Attorney evaluations:
Chen accepted my profile
EP also accepted my profile
Chen offered a “refile until approved” package for approximately $7,000

My main concern is whether my current profile is strong enough for NIW approval or whether I should wait to gain more publications, citations, and other evidence.

At the same time, I’m worried that EB-2 NIW standards or policies may become stricter in the future.

Please advise.

Everyone here should understand something important:

Ivanov v. Trump appears to include a DV-2027 issue, but DV-2027 is not the main focus of that case. The main focus is DV-2026 selectees and the current DV pause. So if Judge Leon’s final judgment does not specifically tell the government to open DV-2027 registration, we should not assume DV-2027 will automatically open.

That does not mean DV-2027 is hopeless.

It means the DV-2027 community may need to organize around a separate legal strategy.

A Change.org petition is good for awareness, but 144 signatures will not force the Department of State to act. What may actually matter is legal pressure.

Two Possible legal pathways:

A separate DV-2027 APA / mandamus lawsuit

The claim would be that DOS is unlawfully withholding or unreasonably delaying a required action: designating and opening the DV-2027 entry period. The requested relief could be a court order requiring DOS to publish DV-2027 instructions and open the E-DV system by a specific deadline.

Congressional pressure

This doesnt require money - but effort.

People with U.S. contacts should ask senators and representatives to send written inquiries to DOS. Congressional pressure is not a lawsuit, but it can support the legal effort and create a public record.

We should stop waiting passively.

If Judge Leon does not specifically mention DV-2027 in the Ivanov judgment, the DV-2027 community should immediately explore a separate legal action focused only on opening registration.

This wis not legal advice.

But we need to be realistic: awareness posts and petitions are not enough.

If DV-2027 is being delayed into nonexistence, the solution is likely organized legal action, not just waiting for another “update soon.”

There is an update regarding Ivanov V.trump which is against the Diversity visa pause on courtlistener.

It appears to be addition of change in data - if someone has access please share it.

My PE is AI in radiology.

My publications are 4 with 3 citations and conference papers are 2 at RSNA and SIIM.

One limited association with US based entity.

Profile - MD in radiology.

The litigation is fully briefed.

Judge Leon is expected to rule anytime soon !

This detailed document on the changes of Diversity visa vetting was made public just a couple of months ago.

But there is still no light at the end of the tunnel.

Why go to such extents if they won’t conduct ?

As of today June 3. 2027, lThe diversity visa lottery aka green card lottery for immigrants has been paused since more than a year and the entry period has been delayed.

Immigrants who attended the 2026 lottery, have also been stuck without interviews and in many cases denied due to the pause.

Ivanov v trump is the major lawsuit by red eagle law challenging to lift the pause.

Five publications - 2 citations - unrelated to my endeavour (AI based)

Collaborated with one US based entity on research.

Not much other US related collaborations.

Chen accepted to file with refile, but they say they cannot guarantee because of the low pubs / citations. Respect that.

Posting here to get opinion on whether I should file now or wait and build ?

I am from one of the oceania countries.

I just came across the latest youtube live of Britsimmons - he mentioned that one of the government lawyers mentioned it would open soon - how credible is the news ?

I know public opinion is it won’t open, including me.

But just wondering how credible has Mr Brit’s track record has been ?
