The Law Society itself does not have the power to disbar a lawyer. Instead, it investigates complaints, and if the misconduct is severe enough, it refers the case to the Court of Three Judges, which is the only legal body with the authority to officially strike a lawyer off the rolls.

I have known Faishal for more than 20 years. I worked closely with him in Nee Soon GRC for 15 years, and more recently in MHA as well. He is my friend and comrade.

You learn a great deal about a person when you work together over a long period of time. You see how they respond when things are difficult. You see what they value.

Faishal is someone who has always been focused on making a difference to the lives of others. He is a true gem. His heart is in the right place – to serve the people. I haven’t come across many people, in or out of government, better than Faishal.

As an MP in Nee Soon and my Ministerial colleague in MHA, he was hardworking, humble, honest, sincere. He carried out his work conscientiously. His contributions were extensive, and can’t be set out in detail here. I will however share three examples.

  1. About 10 years ago, Faishal started the 100=50 initiative in Nee Soon Central to help lower-income residents purchase groceries at more affordable prices. This has helped many families over the years.

He has also never hesitated to help residents personally. There were occasions when he would use his own car to ferry residents with mobility issues to and from their homes.

  1. Faishal embraced Chinese calligraphy as a way of bringing people together across communities. During Chinese New Year celebrations, he would personally write calligraphy pieces for residents. It was his way of celebrating the diversity that makes us strong.

  2. And when residents needed him, he was there. During the COVID-19 pandemic, when multiple COVID-19 cases were detected at a block in Nee Soon Central, Faishal personally visited the affected block to reassure residents and address their concerns. At a time of great anxiety, he was on the ground, listening and helping.

These are not isolated examples. They are consistent with the way Faishal has approached public service throughout his career. That is the man I have known for more than 15 years.

Faishal has had to leave office now in the most unfortunate of circumstances. Many are wondering what happened; what were the standards of conduct that were applied; why Faishal decided to resign.

The standards governing personal conduct in these sorts of situations have been set out previously by Mr Lee Kuan Yew, and more recently by SM Lee Hsien Loong, as PM. The principle is straightforward. Where a matter remains entirely private and inappropriate conduct stops after counselling, it can remain a private matter. But when the matter enters the public domain through a complaint or otherwise, it must be examined and if there has been impropriety appropriate action must follow.

What happened in Faishal’s case? There was a series of online interactions between Faishal and the lady. Faishal explained that he was worried the lady might react negatively if he abruptly cut her off. Nevertheless, his responses were, objectively, inappropriate and questionable. They come across as engaging with her. Indeed, that was how the lady interpreted his responses, and said she was encouraged to continue.

The lady became angry when Faishal subsequently tried to put a stop to the online exchanges. She emailed PM, sent some of the messages and pictures and alleged harassment by Faishal. Faishal too alleged the lady had harassed him. That is why the matter was referred to the Police to investigate.

Once the lady emailed to PM, to complain about Faishal, it ceased being a purely private, consensual matter between two individuals. The lady had escalated the matter, and it was semi-public. She had lodged a complaint against a public office holder. And it became necessary for PMO to consider the appropriateness of Faishal’s interactions.

Faishal was given a fair hearing. Regardless of his intentions, one has to look at the evidence and facts. Faishal himself reflected on the matter and acknowledged that he should not have allowed his exchanges with the lady to carry on, and he should have established clear boundaries from the start. He also came to the conclusion that his position as MP and Minister was untenable. That is why he decided to resign and PM accepted his resignation.

All in all, a very sad situation: A good, honest, humble, hardworking man, who really cares for the people, has had to go. As saddened as I am for my comrade and friend, I hope that he will recover from this tragic turn in his life and will find ways to contribute in different ways to the community and Singapore. He still has much to contribute.
