A few months ago, through a broker, my friends rented an office space in Baneshwor. The landlord is the Campus Chief of a well-known school and college and is also associated with several IT companies.
As per the written agreement, they paid three months’ rent (Rs. 3,45,000) in advance. The office was supposed to be handed over within 20 days after maintenance, followed by an additional 20-day grace period for settling in before the rent officially started.
However, due to delays on the landlord’s side, the maintenance took over 50 days. When my friends followed up, the broker informed them that the landlord had decided the rent had already started from 1st Jestha—even though the office had not been handed over on time and the agreed settlement period was being ignored.
When they questioned this, they were told that the 20-day grace period would not be honored and that if they didn’t agree, they could simply cancel the deal. Considering this breach of the agreement and the lack of trust from the very beginning, they chose to cancel and requested a refund.
The landlord refused to return the money and even said that if they wanted, they could file a legal case.
We sought help from the police, but instead of addressing the issue, they suggested we just take the office and move in.
We feel completely helpless. Rs. 3,45,000 may not be a significant amount to him, but for us, it represents years of hard work and savings.
If you were in our position, what would you do? We would genuinely appreciate any advice or suggestions.
