NFA Ruling- Please Be Patient With Your Local FFLs

I know these are exciting times with the NFA ruling. However, FFLs are still bound to follow federal law and abide by the ATF as well as State Law. There isn't enough guidance out there yet for FFLs to be able to process transfers on just a 4473 yet. I have heard from shops that are getting bombarded and some people have been rude to them because they won't do the transfer on a 4473 yet. Please have patience and understand these are unprecedented times that require clear understanding and guidance from multiple layers of government and attorneys.

I want to be clear just because you heard about the NFA case doesn't make you a law scholar. So please do not go into these shops demanding that they do something because you "know it's now legal". These shops have to ensure that they cross every T and dot every I or they could lose their license. There is still a lot that we don't know and we need the guidance from the ATF. GOA and FFLs are currently hounding the ATF for this guidance.

So here is what you should do at this time. Pay attention to the information that comes out. I will be posting it as I can but you can also follow other areas as well. If you are not a member of GOA then go join because you will be a member of the protected group. Talk to your dealers and if there is a suppressor that you want ask if they will hold it for you until this is worked out.

You should not be giving your FFLs a hard time if they will not do the transfer yet on a 4473. This is coming from their attorneys and they need guidance from the ATF. Do not go in saying things like you know it's legal and the shop is anti-2A. You do not have a law degree and reading things online does not make you a Temu lawyer.

So please be patient and coalesce as a community. We will know more soon.

Update on the NFA Ruling - Huge Win But Still Some Questions

So as of now it looks like the DOJ will not appeal according to Representative Andrew Clyde. However, there is still a bit of uncertainty in most states including Maryland. I have talked with GOA and MSI. We will need to see what the guidance is from the ATF to FFLs. That will give us a clearer picture of how this will all shake out.

Under Maryland law there really is nothing pertaining to suppressors so there is an avenue there for this to benefit members of the protected classes in the lawsuit that live in MD. But again we will need guidance from the ATF.

As for SBRs and SBSs Maryland law says they have to be registered with the federal government in compliance with federal law. Since the law requiring registration is still on the books at the federal level even after this ruling MD could still enforce that provision.

There is also still ambiguity on how this will work with dealers which is why the official guidance needs to come out. For example if you are a dealer and a GOA memeber comes in are you able to transfer the suppressor if the dealer is not Silencer Shop, PSA etc? Do the protections for Silencer Shop and PSA cover their dealer network as well? Are GOA caliber club dealers covered? Or is the dealer ok so long as the person he is selling to is a member of a protected class? GOA is of the opinion that the definition is as broad as possible and if the person buying is a member of a protected class then the dealer is covered. However, we need to see what the ATF guidance is which should come soon.

I was in a GOA meeting Monday and raised questions/concerns about the potential ATF guidance for instance if the ATF says we as dealers need to keep a copy of the proof of membership and/or the ATF says we need to send the 4473 to them within a certain period of time etc. that is creating a list of members or defacto backend registry. As a dealer I'm not required to keep a copy of your ID nor do I send the 4473 to the ATF. They can only see the 4473 during an audit, if there is an investigation, or I go out of business. I can assure you that GOA is geared up to fight this if the ATF tries to play any of these types of games and the requirements are any different than if you were to buy a typical firearm.

So yes it sucks there is still some uncertainty but these are unprecedented times and this is a massive win that we all need to celebrate. When Maryland does it's thing and tries to enact registration requirements, taxes, etc. I will be right there in Annapolis on behalf of GOA fighting tooth and nail. Additionally, I will be working with pro gun politicians in the state to make push laws in the general assembly to align MD with this new era of no NFA.

Designated Collector Issues - Check Your Status on Your 77r

So I have had this happen twice in a little over a week where the MSP system isn't updating the designated collector status. The most recent was about 30 mins ago and the story is below. Bottom line check your designated collector status and have the dealer reach out to MSP live help if it's not updated.

The customer got his DC in Feb of 2026 and had purchased multiple guns in early April with no issue. He had selected the yes box for the DC status and there were no issues.

On 4/16/26 MSP sent an email stating they were changing the way they were doing the applications so neither the customer nor the dealer could check the box it would be on MSP to update it.

This customer had 2 77rs with me and had the not disapproved emails for both and the system said both could be transfered. He came today to pick them both up and I transferred one gun and the other one automatically switched the release day to September. I reached out to live help but no one was there so I reached out to my MSP auditor where I provided all of the emails, screen shots of what happened in the system as well as a copy of the DC letter. My ask was can I transfer the gun and MSP fix the glitch and back date the transfer which they have the ability to do tomorrow.

He reached out to Sgt. Esposito with the licensing decision and provided all of the info. He said no to the transfer so the customer had to go home to PG county and will have to come back to MOCO once MSP fixes their system.

Again this customer was a DC prior to the security update MSP did on the 77r portal and the system had him as a DC prior to that update. Now that information apparently didn't migrate over after the update so this gentleman has not only waited 7 days but has to wait more because of MSP.

Moral of the story check your status to make sure it is correct in the system especially if you have purchased much since April 16th or you haven't purchased multiple guns in 30 days since April 16th. I checked mine and it is good. So it seems like it might be a random thing or maybe for people that got they DC in 2026 which both of these guys had done.

I have talked with the attorney from MSI and he will be reaching out to the licensing division commander on Monday as will I from my GOA email to get this investigated and hopefully it won't happen to anyone else. But again I have had it happen to 2 people in just over a week. I was just lucky that live help was open for the first guy and we got it resolved the same day.

DOJ Files a Lawsuit Against MOCO Carry Ban

Motion for Preliminary Injunction Against MOCO Carry Ban

Just an update the motion for Preliminary Injunction against the MOCO carry ban will be filed tomorrow (Friday) in the MSI lawsuit that I'm part of. Not sure how quickly the court will act on it but MOCO will have to file a response to the motion at a minimum before anything else happens. I will keep everyone updated as much as I can.

GOA Meeting with MD Delegate - Updates on Glock Ban, VZ61 Status, Handgun Roster Board, and Future Pro Gun Legislation

I had a great meeting today with Delegate Lauren Arikan, and I wanted to share a few updates with everyone.

First, I can tell you she is extremely passionate about protecting our Second Amendment rights. This is an issue she genuinely cares about, and she made it clear that she and several other members of the Maryland Freedom Caucus want to help us in these fights.

Glock Ban

I went over the administrative plan that I have been working on, and she's fully on board. Going forward, she'll be copied on communications with MSP, help set up an in-person meeting, and plans to attend with several other members of the General Assembly. If MSP agrees with the plan, the Freedom Caucus will do what they can behind the scenes to protect it from being undone during the next legislative session. I'll keep everyone updated as things move forward.

VZ61

Many of you know that MSP quietly changed the VZ61 to Military/LE Only after it had been legal for civilian sale since 2008, without notifying dealers or the public. I've been working to get this corrected since the end of last year, but MSP has stopped responding.

Delegate Arikan was not happy when she heard what happened. I'll be sending another demand email and copying her on it. If MSP still refuses to act, she'll get involved directly, and we're also looking at addressing this during the Glock meeting. It's encouraging to have legislators willing to step in and push state agencies when something isn't right.

Handgun Roster Board

We also talked about the Handgun Roster Board. She was surprised to learn there are still open seats, that some members are serving after their terms expired, and that appointments have been sitting for months.

I told her I'm applying for the FFL seat and that several others have already applied for the remaining vacancies. If nothing happens over the next month or so, her office plans to file an MPIA request to find out how many applications are pending, what seats they're for, and how long they've been sitting. She's used this approach before, and it's gotten results. If you've been thinking about applying for one of the open seats, I'd encourage you to do it.

Pro-Gun Legislation for Next Session

We're also planning a meeting in early September that should include several members of the General Assembly to start putting together a package of pro-gun bills for the next session.

We know most if not all will not pass, but we want to be on offense instead of always playing defense. Even if a bill doesn't make it through, forcing legislators to vote either in committee or on the floor on popular Second Amendment issues is valuable in itself. We will also try to slip some of these things in broader bills that include things that Democrats do care about as a way to try and get them across the finish line.

Some of the ideas we discussed include:

Stopping the misuse of Maryland's public nuisance law against firearm manufacturers and dealers. This would be done by proposing legislation that aligns with the recent MD Supreme Court decisions stating that highly regulated businesses cannot be sued as a public nuisance because the publics downstream misuse of otherwise lawful products.

Expanding civil liability protections for people who lawfully defend themselves.

Making Maryland a Stand Your Ground state.

Bringing Maryland's sensitive places law into line with Supreme Court precedent.

Closing the loophole that allows counties like Montgomery County to get around the state's firearm preemption law.

Looking at reforms to Maryland's assault weapon laws and several other firearm statutes.

This is just the beginning, and I'm sure we'll have plenty more ideas before the session starts.

GOA Won a Preliminary Injunction Against the VA AWB.

The judge ruled from the bench today in Lancaster County VA that the law cannot be enforced. The injunction remains in effect until 12/31 or until a final order is issued in the case.

I'm sure the State will immediately appeal but we will see what happens. More details should be coming out shortly.

SCOTUS dropped the opinion in the Wolford v. Lopez case today. I'm still reading the opinion to see what was said and how it could be used in our favor in the future.

However, at a high level the court ruled in a 6-3 decision that Hawaii's law creating a default gun free zone in private property otherwise open to the public was unconstitutional.

I will continue to update as I get through the opinion but I'm in an OSHA 30 class today so I'm a bit limited on time at the moment.

Update: I texted Mark Pennank with MSI asking him how much he thought this opinion would help with things like the MOCO carry ban. His response was "Definitely Helps. A lot."

Two Court Opinions Today SCOTUS and Virginia

US v. Hemani

Sorry I had foot surgery yesterday and haven't been up to par today so I haven't been able to fully study the Hemani decision. However, from what I have seen by breezing through it is the court unanimously ruled that the prohibition on owing firearms by people who use controled substances has been struck down. This is section 922(g)(3) and if you remember that was the federal statute Hunter Biden was convicted of violating.

At a high level this ruling means that you cannot be prevented from owning a firearm for merely using a controlled substance. However, the opinion did leave room for the Government to still charge you if they can prove that the use of a drug or combo of drugs makes you as an individual a violent person that is too dangerous to own a firearm.This is a much greater burden on the government to prove and has to be applied to an individual and not an over arching group like the law did previously.

There are a lot of other nuances in the opinion and concurring opinion but I just haven't felt up to diving into it yet today. I will likely do a video analysis of it once I'm back to myself and post it on YouTube in the coming days. In the mean time I have included the link to the opinion below for you to read if you like

Spotsylvania Circuit Court

If you all haven't been following there were multiple cases filed against the Virginia AWB. Most of those cases were stayed and a 3 judge panel has been appointed to review those cases and see if they should be combined.

However, one of the cases was heard yesterday and the opinion came out today. This case attacked the law from a different direction than the other cases. I think this was a very unique approach and it was able to get the case heard but ultimately the court denied the preliminary injunction meaning that unless something happens in one of the other cases the VA AWB will go into effect on July 1st. Now GOA did file a Writ of Mandamus for the VA Supreme Court to force the court in Lancaster to hear their case but I'm not sure if that will actually happen.

Again I haven't really been able to dig into this opinion either as it just came out but there were some interesting arguments made and honestly I'm not sure if some of them were in our best interest. I will dig more into it and provide further thoughts but the link below has the opinion.

This YouTube channel is something new that I had be considering doing for a while now. This will be where I will post videos such as this board meeting, MD GOA updates, political commentary, legislative updates, lawsuit updates, gun and gear information etc. I will also plan to have guests on as well.

UPDATE: Handgun Roster Board Meeting- Gen 6s APPROVED!!

First thank you to everyone that came out and. All of the support. We definitely outnumbered the anti-gun crowd. Unfortunately, we didn't have enough people to take all of the seats but we were able to make Marylanders Against Gun Violence sit in the back. I did video the meeting and will upload it to YouTube as soon as I can and will post the link here. My battery did die during some of the discussion on one of the AR Pistols but I was able to get it back up and running after a couple of minutes.

It looks like the lawsuit has put the board somewhat back in check. Almost all of the guns were approved including the Glock Gen 6s. There were some that were tabled and those were generally because members of the board were questioning if it was actually a pistol because it had a brace and I quote from one board member (I have seen YouTube videos where they are fired from the shoulder in 90% of the videos I watched) I have listed the guns that were tabled below.

Some important notes the Dealer that holds the FFL seat needs to go. He is not a fan of pistol braces and never pushed back really hard on some members of the board and their arguments against the braces. I will be applying for that seat as his term was up in 2024 and I encourage any other FFL to apply as well. The board member is Carl Roy the owner of Maryland Small Arms Range. So do with that information as you please.

If you are an electrical or mechanical engineer please apply for the board. Also citizens please apply for the open citizen seat.

  1. Be respectful we do not want to be like the gun grabbers. Let's be respectful and civilized.

  2. Feel free to wear pro 2a attire so they know who we are.

  3. I don't know if they will allow public comment but if they do I encourage everyone to take advantage of that time and speak.

  4. If we are able to book up all the seats early and a pro gun attorney arrives I would ask that someone be willing to give up a seat for them as they are the ones that will be taking the fight back to the courts if the board continues down the same path.

  5. If anyone from organizations like Marylanders Against Gun Violence is there and they start to ask you all questions feel free to talk to them but again be respectful. I guarantee if we pack the house they will be pissed and try to do a social media campaign about it. If you don't want to talk to them feel free to send them my way. Same goes for any press (I doubt there will be any press)

MOCO is trying again to restrict where you can have a firearm.

In response to the recent MD Supreme Court decision in Engage Armament v. Montgomery County the MOCO Council has presented an expedited bill to restrict where you can have a firearm in the county. Unfortunately, the MD Supreme Court decision did give the county latitude to restrict firearms within 100 yards of a place of public assembly. The court only narrowed the definition of a place of public assembly by removing hospitals, long term care facilities, childcare facilities, and government buildings. It also stated that the county could not restrict someone with a wear and carry permit from traveling on a road within the 100 yard prohibited zone. Keep in mind the definition of a place of public assembly includes not just the building but also the parking lot and grounds. So the 100 yard zone is 100 yards from the property line.

The MOCO Council is trying to push an expedited bill to try and align with the court ruling. However, the bill still lists some of the places the court said did not qualify as places of public assembly. The council is also including the exemption for permit holders while driving down the road. However, you still would not be exempt as a permit holder from the general prohibitions in the bill if you are not driving.

For example if you go to Church as I do you have to choose between your First Amendment right and Second Amendment right you can't do both under the bill.

There is a public hearing on the bill on June 9th and I would encourage all MOCO residents to be in attendance if possible and to sign up to speak against the bill if you would like. You can sign up to speak at the link below and the deadline to sign up is June 8th at 2pm. However, signing up earlier would be better. I have already signed up to speak. Handgun Roster Board Update (sorry it's long lots of information)

Here is the update on the Board Meeting. I spoke to the woman that coordinates everything. It sounds like there will be more board members there in June however 2 of the members are new and they replaced 2 of the pro gun members. One is a police chief so hopefully he will be pro gun but the second one is a doctor at Johns Hopkins in the gun violence area so I'm not hopeful about that one. Kim the lady that denied everything in March is not supposed to be in attendance.

This meeting will be a LONG MEETING!

  1. There will be a hearing at the beginning for one of the guns that was denied in the March meeting.

  2. After the hearing then the board will review the court case where the judge ruled they were arbitrary and capricious and vacated the denials for 4 guns. The Board will discuss that cour decision and make a decision about the 4 guns. Hopefully the court decision will set precedent and make the rest of the meeting go smoothly.

  3. They are pushing close to 200 guns on the agenda and they won't touch those until after the first 2 sessions are complete.

I still want as many people as possible to show up. However, they are limiting attendance in the room to 35 total people due to fire marshall occupancy restrictions or so they say. However, you can still come and if you don't get into the room you can still stand outside of the room or even stand outside and they can see you all through the windows the point is to let them know we are there and we are tired of the shenanigans. I'm getting there really early to ensure I have a seat in the room and will be taking notes. I will also have a prepared statement that depending on how the meeting goes I may try to speak before the board.

On a side note the Executive Director of Marylanders Against Gun Violence has been lobbying to get anit-gun people on the board. I will probably start playing that game in the future and try to stack the board with pro-gun people. There is one seat that could be filled potentially by someone who has a mechanical or electrical engineering degree. So if anyone meets that criteria DM me.

Lastly, with the limited seating the lady from Marylanders against gun violence does not get a guaranteed seat. So if a large crowd of us show up really early and just wait then she wouldn't get a seat and would have to sit outside. That would be hilarious and make her livid!!🤣 She would probably write a crybaby article about it. That all being said if we do this I would need people who are willing to give up their seat in the event some of the pro gun attorneys show up. We want them in the room because they are the ones that take the board to court.
