Let’s just get this straight.
Once and for all: even if DG wins a civil claim, the court cannot magically produce money that the defendant doesn’t have.
If the person who actually signed the contract is the defendant and genuinely has no money or worthwhile assets, DG could obtain a County Court judgment for the debt/damages plus whatever costs and interest the court allows. If it isn’t paid, DG can then try enforcement: deductions from earnings in appropriate circumstances, enforcement agents against goods, a third-party debt order against money held by someone such as a bank, or a charging order if the debtor owns property or another suitable asset.
But those enforcement methods only work when there is something to enforce against. A bailiff cannot seize somebody else’s belongings merely because they live together; a charging order can’t be put on somebody else’s house simply because they’re associated with the debtor; and another person’s income isn’t automatically available to satisfy the judgment.
A judgment can therefore be completely valid yet very difficult or impossible to recover in practice if the debtor has no income or assets available for enforcement.
And importantly, winning a civil case does not automatically cause the defendant’s entire finances to be investigated for benefit fraud or reported to DWP. That’s a separate issue.
DG is an idiot. 🙂
Taken a couple of months but I think it’s quite pretty 🙂
