Feeling misled by Sellers and their Agent.

Need some honest opinions from people familiar with real estate disclosure norms because this situation left a really bad taste in my mouth.

My wife and I went under contract on a home in a wealthy suburban area on a 1.5 acre lot. One of the big selling points for us was the backyard/lifestyle potential since we eventually wanted to install a pool. The listing heavily emphasised things like “a backyard that was built for summer”.

During inspections/due diligence we discovered there is actually a very large diagonal conservation/utility easement cutting through a major portion of the backyard. From what we’ve been told it likely prevents putting in a pool in the most usable area of the property (basically you wouldn’t be able to put in a pool even further from the very large easement because of a slop that ends the backyard).

Here’s the part that really bothers me:

  1. The easement was apparently shown on the seller’s survey,
  2. The listing agent admitted they already knew about it
  3. but on the seller disclosure form they checked “No” to being aware of easements affecting the property.

Now I understand easements can technically be public record and buyers are expected to due diligence. But this doesn’t feel like some tiny utility strip on the edge of the property but this materially affects backyard use and arguably resale value on what is a premium lot.

At this point I honestly feel less upset about the pool itself and more bothered by the trust issue. If this had been disclosed upfront our offer likely would have been substantially different (house was already overpriced) or we likely would have continued looking at other properties in the area.

Am I overreacting here or would most buyers view this as a serious omission? Also curious how much people think something like this realistically impacts value/resale on a higher end suburban property.
