H-1B to H-4 after getting laid off. Looking for recent experiences
Hi everyone, I was recently laid off from my H-1B job and I’m trying to understand the process of moving from H-1B to H-4 while I look for another job. My wife is currently on H-1B, but she does not have an approved I-140. I do have an approved I-140 from my employment. From what I understand, I can move to H-4 based on my wife’s H-1B status, but I would not be eligible for an H-4 EAD since her I-140 is not approved.
My plan is to change to H-4 so I can remain in the US while I search for another H-1B position. Once I find a job, I would then have the new employer file for my H-1B and change my status back to H-1B.
Has anyone gone through the H-1B to H-4 change of status recently, especially in 2026? I’d really like to understand how the process works, how long it typically takes, and whether I should use an immigration lawyer or if it’s something I can file myself.
I’m also trying to understand whether moving to H-4 is a good approach in my situation, considering I have an approved I-140 and ultimately want to return to H-1B once I find a new job.
Would really appreciate hearing from anyone who has recently gone through this process and can share their process, timeline, experience, or any things I should be careful about.
