My barber decided to leave a little "nub" tail on my head
Hi Team! Making this post because I feel like the EB1A to 485 process is not talked about a lot on this sub, and I could not for the life of me find any info that helped with the stress and uncertainty.
To preface this:
I'm Mexican, born and raised in Mexico. Mexican passport only. Moved to the US in 2018 for college under an F1 visa. College from 2018–2021, and then did OPT from Oct 2021 to Oct 2022. This is in the arts industry, specifically the film industry.
When my OPT was set to expire, I applied with premium processing for an O1B, got approved in 2 weeks, and I already had my SSN from the OPT so I could start working again immediately. My O1B was agent-based, but had a 3-year contract with a production company.
Then, once the 3 years were coming to an end (Oct 2025), I decided to test my skills and luck and applied for an EB1A. I started the process in June 2025. My case was about 400–500 pages, self-petitioned with a lawyer. They prepared everything. I believe we submitted 8 criteria out of the 10, but I can't talk about the ones that got approved since I never saw the official approval notice. Premium processing was used once again. Got approved on 07/15/2025, about 2 weeks after the receipt date of 06/25/2025.
From that moment, it took me about 10 days to finalize all the paperwork needed for the 485 process. Here is the timeline.
Silence.....
And since my O1B would expire on October 10, 2025, and I'd risk losing my work permit... I applied for an O1B extension, which was received October 3, 2025. Without an immediate approval, this gave me a 240-day extension while waiting for the final decision, which would take me to June 7, 2026. This gave me insane relief because I could keep working!
From an I-9 perspective, I needed to send my latest I-94 + the 797c Receipt Notice, which showed my case extension had been received so I could keep working. Most employers didn't make a fuss about it; others needed the official USCIS policy, so I shared it with them when needed.
Then...
Once these two documents were approved, I felt better about the whole situation, but my 485 case was seemingly stalled. There were no silent updates at all; the last update was the biometrics appt on Aug 19, 2025. From there, I reached out to the EMMA agents, and they said conflicting things:
This stressed me out. There aren't many cases shared online about EB1A-based 485s that required an interview... So anyways, now all I could do was wait... right?
There were no more case updates and I was growing impatient. My O1B extension wasn't getting a final decision either (which, to be honest, I think might have triggered my interview... but I couldn't afford to stop working).
Once March 2026 comes, I start doubting the 485 case would have a final decision by June 7th. And remember, up to this point, I hadn't used the EAD card given to me with the 485 concurrent filing. Why? Because if the 485 gets denied and you've used the green-card-based EAD, you have to leave the country immediately. By using my O1B extension, I was able to have a safety net I could fall back on.
But my career was growing so much that I had to consider the possibility of becoming an LLC S-Corp, and under an O1B, you can't own a company in the US without a US citizen partner. So after weighing my options, I decided to jump on my EAD, leave the O1B behind, and risk it for the biscuit.
At the same time, I was still growing impatient for the 485, so I decided to reach out to my local congressman on March 19, 2026. They said around March 24th that USCIS takes 3–4 weeks to respond, but I guess I was extremely lucky and got a response on April 1st stating that my case was in Los Angeles waiting for an interview to be scheduled.
That triggered USCIS to send me an official Interview Scheduled Notice on Apr 3, 2026, which meant my interview was set for May 12, 2026.
There are no links that will prepare you for the interview. When I asked my lawyer, she mentioned that I didn't need to bring any documents to the interview since USCIS already had everything on file. I didn't trust it... I printed my whole 485 case, paystubs, the P&L of my new company (opened it March 22, so it was only 7 weeks old when I had the interview), and brought what my CPA prepared for my 2025 taxes.
Appt is at 9:30am. I got there at 9:15am, went through their airport-like security quickly, and by 9:22am I was checking in. I barely had any time to sit down before the officer called me in, just a little earlier than my 9:30am appointment.
I enter the room, swear the oath, and the interview starts. He asks for my passport and my driver's license. He then asks me what my status was when I came to the US. I mentioned my 3 years on F1, 1 year OPT, and 3 years on O1B.
He asks when I started filing taxes in the US. I said since 2022 with my OPT. He asked how much money I make, very straightforward, as well as to explain my "extraordinary ability," and I answered. He then asked for my taxes for the last 3 years... I panic a little, tell him I only had 2025 on me, and he asks for my W-2 income. This is where the conversation gets complicated.
My income is mostly 1099; I'm working on a project-to-project basis for multiple employers and multiple payroll companies. My income is split roughly 70% 1099 and 30% W-2.
He sees the W-2 form and mentions that I don't make good money, and that the amount I mentioned earlier is not there. I tried to explain that my income is 1099 for the most part, and I offer to show him the 1099 income + the profit and loss from my company. He avoids it, saying that he wants to see the W-2. I insist and try to explain the income distribution and the nature of my business. He finally asks for one specific document—my Schedule C—and after scrambling around through my 190-page binder trying to provide proof of things he hadn't even asked for, I can't find that single page.
It takes me a couple of minutes. He mentions he'll take a quick break, goes to the bathroom, and comes back moments later. Throughout this time, I'm still looking for the form... He sits down and I'm still scrambling. Here, I blame the nerves and being overly prepared with the wrong things, but to be fair, my lawyer had mentioned no need to bring any documents!
He says: "Okay, you're not prepared, I'll give you a chance to provide the documentation after this interview." To me, that sounded like an RFE. He makes me sign a document confirming that I'm not hiding anything and telling only the truth.
The moment he turns around to his computer, I finally find the document! I give it to him and he looks at it. He scans it, scans my P&L, and starts judging why my company had a loss of X amount and no profit. That's when I explained that it was an investment made using a credit card, and I did the accelerated depreciation for the asset that was bought.
He had an "Ok" reaction, went to type on his computer for a moment. Turned around to me and goes, "Okay, your case has been......" Silence. "Approved. You'll receive your card in about 2–4 weeks."
I said thank you, stood up, and tried to shake his hand—which he wasn't very excited about and then shushed me away lol.
Left the building for the day. 24 hours later on May 13, 2026, the portal updated saying my case was approved. The card was produced May 18th, and I picked it up May 28th from my lawyer's office.
Finally greened after almost 8 years in this country, all because of my merits. Never wanted to get my residency by getting married.
Hope this helps y'all, it was a lot.
