Need advice: I’ve been living in a rental for 4+ years but never had a copy of the original lease

Hi everyone,

I moved into my apartment over four years ago with some friends through a lease transfer. I’ve never been the person in charge of managing the apartment (communicating with the landlord, etc.), but my friends gradually moved out, and now I’m the only tenant living here.

I’ve never had a copy of the lease since the transfer, just verbal instructions from the landlord when we moved in. I think we never actually received a copy, or if we did, it’s with friends I can no longer contact.

I’ve asked my landlord for a copy of the original lease, but he hasn’t given it to me. Is he supposed to keep a copy? What should I do if he says he doesn’t have it or refuses?

Small claims

Hi everyone! I have a dispute with someone for a debt of less than 5000$. I want to send a formal notice (mise en demeure) and open a case at the small claims court in Quebec, but I don't have the other party's address.

I've tried to contact them multiple times but they've blocked every means of communication I've used and are unresponsive.

I have their name, phone number and employer information.

I found this online, but I'm not sure it's applicable in my case, as I understand a mise en demeure is mandatory to file a case in small claims for this amount and I can't prove it was received

If the defendant cannot be located, the clerk must, as soon as possible, publish a public notice on Internet or in a newspaper, asking the defendant to collect the application at the court office or risk having a judgment entered against him or her.

If the defendant refuses to receive the application or fails to pick up mail, the clerk will ask a bailiff to serve the application and charge the cost to the defendant.

Hi everyone,

I’m looking for advice on what options I might have in this situation.

I had a roommate who was subletting a room from me. They were not on the lease, and we didn’t have a written contract, just a verbal agreement that they would pay a portion of rent and utilities.

They’ve now moved out and left without paying a significant amount of utilities. We tracked all shared expenses and payments through an app, so I have a full history of what was owed vs. paid. I also have receipts for payments they did make (via Interac), which helps establish a pattern of contribution.

The issue is:

- No written agreement

- They’re not on the lease

- I only have their name and phone number (their social media is private)

Is there any realistic way to proceed or is this basically a lost cause?
