Tata Motors dealership tried to give me a showroom display car despite explicitly asking for a brand-new vehicle, what should I do?
I recently booked a Tata Nexon from a Tata Motors dealership.
Right from the beginning, we clearly told the salesperson that we did not want a display/demo vehicle since there was the exact variant of the exact colour we wanted on display at the showroom and wanted a brand-new car.
We made the entire payment due to pressure from their side that the price will increase in august starting from the start of the month itself. (We booked at the end of july)
During the PDI, we discovered that the vehicle allocated to us was actually the same car that had been kept on display in the showroom.
Fortunately, we had recorded a video during our first visit to the showroom, which clearly shows the same vehicle being displayed. So we have evidence that this was a display car.
We immediately rejected the vehicle.
What makes this more concerning is that the invoice had already been generated and insurance had already been processed before we had even completed/accepted the PDI. I even had to stop the guy from doing RTO registration because I wanted to do PDI first.
We have already spoken to the salesperson, GM and VP, and sent a formal email to the GM with all the details and evidence. We have now also raised a complaint with Tata Motors Customer Care.
The dealership has apparently told us that the cancellation/reversal can only be processed after the end of the month. We have not been given a satisfactory explanation for this.
We have made it clear that:
- We will not accept the display vehicle.
- We will only accept a brand-new, unused vehicle.
- We will not pay any cancellation/insurance/administrative charges arising because of this issue.
There is no proper communication from the dealers end and they keep asking for a few days more every time.
My questions to the Tata owners/community:
- Has anyone faced something similar with a Tata dealership?
- Can the dealership legitimately delay cancellation/reversal until the end of the month?
- What is the best way to escalate this with Tata Motors if the dealership doesn't resolve it?
- Is there anything else I should do to protect myself legally/financially at this stage?
Would appreciate advice from anyone who has dealt with a similar situation.
