"We aren't done in California, Protect Our Games has one MASSIVE oversight"
Act AB-1921 (when simplified), says that players must be given a playable copy of their videogame after the studio shuts it down. Otherwise, anyone who owned a copy is Entitled to a refund.
This would be a slam dunk, except this bill only allows for public enforcement, there’s no private right-of-action. If Ubisoft kills your game, you cannot bring them* to civil court for your refund, your attorney general or district attorneys need to do it on your behalf
This is bad, because politically, game shutdowns are incredibly low-priority. It can be a nightmare convincing politicians to enforce even the biggest laws, especially against corporations. Keep in mind, these game shutdowns are already illegal in a lot of EU countries, it just isn’t being enforced.
Unless AB-1921 is amended to include private right-of-action, this isn’t a meaningful change, companies have already been crossing this line for years
Luckily, the bill hasn’t been fully passed, it’s in the exact phase where amendments are happening. If you live in California, I’m gonna list what you should do. If you don’t live there, send this to your california friend, we all have one
1: First thing to do is email assemblymember Christopher Ward, the current bill author.
You can find him at Assemblymember.Ward@assembly.ca.gov.
I’ll give you a template, but keep it brief, he’s got a lot on his plate right now:
SUBJECT: “AB 1921 — Please add a private right of action”
TEXT: “Dear Assemblymember Ward and staff, I support AB 1921, but I urge you to amend it, and include a private right of action. Affected purchasers must be able to bring civil actions for injunctive relief,restitution/refunds, reasonable attorney’s fees, and statutory damages for willful violations.
Without a private right of action, enforcement would be public-only, which will leave many violations unaddressed when prosecutors lack time, resources, or political incentive. Adding private enforcement would make AB-1921 much stronger, while still targeting only direct harm to purchasers.”
2: Right now, the bill is being seen by the Rules Committee, and it’ll soon be sent to the Policy Committee. Once this happens, send an email to SPDTCP.Committee@sen.ca.gov, saying precisely: “Support AB-1921, but respectfully request that it be amended to add a narrow private right of action.”
Do not edit the wording on this one. For reasons I don’t wanna get into, your email will be disregarded if it doesn’t meet strict criteria, your best-bet is to copy me directly. Next, send more emails about the importance of including a private right-of-action, to individual committee members this time. I’ll give you the list:
