The eradicator protocol was mentioned in season 2 and brainiac CPU is still around. Plus concept art shows a character that might be him he is the only one out of the four supermen not to show up yet.

Although Black Cat 99% isn’t appearing in Brand New Day I wonder if Peter might make an off hand mention of her or she is hinted at. Art by Alex Ross

Considering four years have passed and it seems like will get an opening montage of villains Peter fought. She is too big a character for them to cast an unknown for a 5 second sequence so a mention would make more sense then have her fully appear in Spider-Man 5.
