H1B Approved. Finally done with HHS waiver process!

My J-1 Waiver → H-1B Timeline:

HHS filed: 2/2/2026
HHS approval: 6/4/2026
DOS (State Dept.) approval: 6/15/2026. Applied for H-1B with USCIS shortly after, by end of June
USCIS (SRC) waiver approval: 8/3/2026
H-1B upgraded to premium processing on the day of USCIS approval, approved 8/19/2026

Two things that caused me a lot of stress (sharing in case it helps someone else):

- I did one extra year of training after residency and still got my HHS waiver approved for a hospitalist job. My initial contract start date was within 12 months of finishing residency. I finished residency 6/28/2025, and the contract start date we listed was 6/27/2026 (literally one day inside the window). I ended up not actually starting by that date, but the waiver was still processed and approved. I’ll be starting 8/24/2026.

- I wasn’t eligible for a board extension, so I secured lawful status by making sure my H-1B petition was filed before my DS 2019 end date (before 6/30/2026). A pending H-1B keeps you out of unlawful status. We filed it as regular processing to avoid triggering an RFE, then upgraded to premium processing once we got the USCIS approval, and got the H-1B approved within 15 days.

There was a lot of speculation and conflicting advice about both of these points, and I’m relieved I took the risk and it worked out. Sharing this for anyone going through the same thing.

App for tracking USCIS case

I found this app on the Apple Store. It’s useful for tracking your case and receiving notifications whenever there’s any change without going back and forth to the website. However, I advise against subscribing to their premium plan. My friend’s account had it, and it seemed to be filled with data based on small number of cases and their prediction is inaccurate.

Driving in the US / Can’t renew my license without visa

Hi everyone,

My driver’s license is expiring soon, and I don’t have an DS extension. Since I’m staying in the US beyond the grace period by “pending H1B petition,” I’m wondering if there’s any way to drive legally. Can I get permits? Or is it possible to drive using my home country driver’s license? Any ideas?

For future reference! HHS Waiver Delays due to "For Cause" Termination & $100K Fee Clauses (My Experience)

Hi everyone,
I was one of the applicants where the hospital I signed with mentioned a "$100,000 fee as cause of termination if applied on me," and this was the major cause of delay (at least to my case). I want to explain why so those of you negotiating contracts next year can avoid it!

The major risk here is outright rejection of your waiver application. HHS rules strictly state that you can only be terminated "for cause." Because "for cause" isn't explicitly defined in federal regulations, putting a massive $100,000 financial penalty or fee into the termination clause creates a massive gray area. HHS looks at that and worries the employer is creating a loophole to fire you without proper cause, which violates the core waiver requirements.

HHS explicitly noted there was a real risk of rejecting the application based solely on this contractual provision.
The only reason my case survived is because HHS ultimately elected to take the regulatory risk themselves, process it, and forward it to the Department of State. They realized this $100K fee usually applies to H-1B petitions for people outside the U.S., whereas J-1 waiver docs are already here completing graduate medical training.

If you are negotiating your contract for next year, do not take this gamble. A different reviewer might just reject your application instead of passing it through. Make sure your contract says termination is "for cause" only, and fight to get these weird fee and penalty clauses removed before you sign!

To be honest, I wasn't even aware of this issue until recently, and I found out completely by accident. The hospital never mentioned it to me beforehand, nor did they tell me that HHS had reached out to them questioning that weird termination clause. I just happened to find out and don’t ask me how! :)

Moving to Connecticut From Boston as a Young Doctor — Advice on Living Around Hartford?

HHS waiver website updated 5/19/2026! Good news for people with extra year of training!

I am sharing this because the newly updated website explicitly clarifies two key points for people who did extra year of training :

  1. Eligibility for Additional Training:

“Physicians who have completed additional qualifying training (e.g., geriatrics, addiction medicine, or child and adolescent psychiatry) may be eligible, provided that their training and start-of-service timing comply with 45 CFR 505.5(b).”

2.Clarification on the "12-Month Rule" & Employment Contracts:
The language in 45 CFR specifically references "12 months before the date of commencement of employment listed in the contract," rather than the actual physical start date of employment. Furthermore, the paragraph notes:

"This HHS eligibility requirement relates only to eligibility for an HHS waiver request and does not relieve physicians of the responsibility to maintain lawful status."

In the middle of this delayed process, I think this is a very reassuring clarification from them for anyone applied after a year of training!

It would be very helpful to keep tracking the progress if you could also share the date of your HHS application receipt/acknowledgment, rather than only the DOS date, since it usually takes some time for the case to appear there. Hopefully we continue to see more updates :)
