Most often , the common home buyer relies on the bank's due diligence to see if property is ok or not. Banks don't care that much as they know they'll mostly recover their money from the borrower -- especially from the high CIBIL ones.

I recently had a personal situation in which the builder was trying to sell me the road which belongs to the government as part of a plot. Bank also approved the property after technical visit and verification. It was me who discovered what level of fraud the builder was trying to do. Eventually the builder -- unapologetically -- just said that site engineer made a mistake. And bank in this case is HDFC. Both the project and my individual plot was approved by them.

Surcharge on tax

Isn't the surcharge applicable if your taxable income (not total income) exceeds the thresholds (50 lacs, 1 crore etc)?

The way the tax utility works is on total income and not taxable income. My taxable income is below the threshold but total income is above the threshold -- and I'm being charged the surcharge.

This feels totally unreasonable and unfair (not that our government offers much reason and fair treatment anyway).

Compulsory club subscription charges

Scenario is: the builder retained the ownership over the clubhouse of the community. They charged a lifetime membership fee to the buyers at the time of property purchase. The club will never be transferred to the owner's association.

Now the builder wants to levy compulsory monthly subscription charges to this clubhouse.

If someone chooses not to use the clubhouse (and forgets about the upfront membership fee as a sunk cost), can the builder legally demand monthly subscription charges?
