Settlement day. Things are packed. The place is clean. All ready to hand over the keys. The buyer suddenly sends on some photos of the most minor things and demands a several $k discount. Yeah nah, my solicitor counters. Well then, I'm invoking clause 6.2 and will bang my pots and pans like a child for the next 5 business days just because.
Nothing changes, they finally settle a week later without the last minute discount.... My solicitor informs me, this is becoming more common.
Fortunately for me, I wasn't really impacted beyond minor inconvenience levels. But, what if I was waiting to settle on somewhere else? What if I had a trip booked or a deal to close? I would have been (and this is what the buyer is obviously counting on) totally screwed.
Clause 6.2(Qld) was to my understanding, brought in to help settlements happen during covid when things just couldn't work because of random open / closed rules. Please don't use this as a last minute bargaining tool. You're only stuffing multiple people around for no good reason. Building and pest is when your dealing is done, not on settlement day. Using it for anything other than emergencies, really is just being a cock for no real reason at all.
