Wife’s Extramarital Affair: What Can the Husband Do Legally?
I am seeking guidance from Indian lawyers, particularly those experienced in family law and Muslim personal law.
A Muslim husband and wife performed their nikah according to Islamic customs in November 2025. Their marriage has not been formally registered, and they have no children. Both are currently connected to Ahmedabad, Gujarat.
After approximately 4–5 months of marriage, the husband allegedly discovered that his wife was communicating romantically with other men. According to him, this behaviour stopped temporarily but later resumed. He has evidence of conversations, voice notes, photographs, video calls, and messages exchanged after the marriage through Instagram, Snapchat, and WhatsApp.
The husband says he has preserved this evidence. He accessed the accounts using credentials he knew through a Gmail account the wife had shared with him.
The wife has been living at her parents’ home for approximately one month following an argument between the couple. Her parents are reportedly unaware of the alleged affairs. When the families discussed the situation, the wife denied the allegations, while her father requested that the husband give the marriage another chance.
However, the husband believes he has already given multiple chances and does not wish to continue the marriage. The wife has not clearly expressed a desire to return and reconcile.
The husband is currently unemployed and financially dependent on his parents. His main concern is that his father-in-law may initiate a harassment-related complaint against him and his family if he proceeds with the separation.
I would appreciate legal guidance on the following questions:
Since the nikah was performed according to Islamic customs but the marriage has not been registered, what is the legally appropriate procedure for ending the marriage under Muslim personal law in India?
If the wife’s family files a police complaint alleging harassment or cruelty against the husband and his family, what immediate legal steps should they take?
What precautions should the husband take now to protect himself and his family against potentially false allegations?
Can the husband legally rely on the digital evidence of the alleged extramarital relationships? Are there any privacy or admissibility issues concerning how the evidence was obtained?
Given that the husband is unemployed and has no children with his wife, what potential maintenance obligations or other financial liabilities should he understand before proceeding?
Should he consult a family-law advocate and send a formal legal notice before taking any steps towards talaq?
I am looking for practical, legally accurate advice under Indian law, particularly as applicable in Gujarat.
Thank you to everyone who can provide informed guidance.
