SF1750, coauthored by Representatives Kristin Bahner and Shane Mekeland, and Senators Eric Lucero and Susan Pha, would create protections for homeowners living in HOAs. It passed on a 100-34 vote in the House of Representatives. It goes to the State Senate for repassage and from there the Governor’s Office to sign into law.

Among its provisions:

  • Caps on fines and fees
  • Prohibitions against conflicts of interest of boards
  • Requires multiple bids for contracts
  • Prohibits foreclosures solely on unpaid fines or attorney fees.
  • Prohibits counties and municipalities from requiring certain features that would require an HOA in order to approve a development project
  • Protections for Safe at Home participants from violations of their address privacy.
