Why were U.S. Marshals participating in David’s arrest?

For those of you who don’t know, the United States Marshals are a federal law-enforcement agency. Have you ever seen the old Harrison Ford movie called “the fugitive”? OK it was a remake of an original TV series but…shut up! NOT THE POINT, NERD! A great iron maiden song by the way…

Anyway! Harrison Ford’s character was accused of killing his wife so he ran after he was sentenced to death hence the name of the movie. Because he was a fugitive, the US marshals were hunting him.

But David wasn’t fugitive. He wasn’t avoiding prosecution. He didn’t fail to show up in court like Neo. Up until the point of his arrest, he was a free man who could go wherever he wanted.

Also, unlike his ol’ pal, he wasn’t in another state. He was located in the exact same jurisdiction where the crime is alleged to have occurred.

So if he’s not a fugitive and he didn’t cross state lines, then why are US marshals getting involved in his arrest?

This makes me wonder a few things:

  1. was it because of the CSAM that was recovered from his phone and iCloud? Generally speaking that type of material falls right into the lap of the federal government.

  2. did they think he was going to run? Is that why he was arrested seemingly out of the blue? Because they believed he was going to flee the state or country? Not only did they come in hot and heavy, but they threatened to use less than lethal force and send the dogs after him if he ran.

Thoughts? I’m hoping some legal scholars or law-enforcement experts can weigh in here.

PSA: Regurgitated information

Ok. Been seeing a lot of posts about various TikTok and YouTube videos posted by various content creators.

Couple of things:

I don’t care if the content creators are also attorneys, law-enforcement, journalists, private investigators, butchers, bakers, or candlestick makers, current or former, they all have one thing in common: NONE of them have the evidence.

That means they’re just speculating like we are. If they’re big enough, they might have a team of people who are scouring Reddit, TikTok, Instagram, MySpace (remember that? No, you weren’t born yet). But just because they present what they have in a somewhat professional and flashy manner doesn’t make it official or 100% true. And let’s talk about what they have.

I mentioned about them getting stuff off of social media platforms. So that’s what happens when there’s a lull in the action. See they gotta still make content if they want that revenue. They’re not waiting until mid June and late June for the next hearings. The audience wants more so they gotta give it to em! So what did they do? What we do: go on social media and find little things that are attention grabbing.

TL;DR: no one knows anything beyond what has been coming out of the courthouse. So, chill out. Don’t be an eager little piggy ready for some slop. Or at least consume it with the knowledge that it’s slop and not filet mignon.

Flashback: How sloppy evidence gathering can dismantle a prosecution’s case.

From the information shared by the prosecutor, it does sound like David has no chance at being acquitted. And that is just a little we’ve been told about.

I’m sharing this video to show everyone how a good defense team can utterly dismantle a prosecution’s case no matter how strong of a case, the prosecution believes it has. The name of the game is “sowing reasonable doubt”. You need to erode the jury’s trust in the evidence and the O.J. Simpson trial was a master class in doing just that.

The whole video is well worth your time, but for those of you with limited time or attention spans, I just want to focus on one specific way the defense team nullified some of the evidence.

Now, I’m not doing this to be a doomsayer. I just want to remind (or show) everyone how presumption of innocence and reasonable doubt can’t become a sniper rifle in the hands of a shrewd defense attorney.

As conversations continue to happen around the developments in the criminal case against David Anthony Burke, I thought it would be helpful to (re)orient people to the three primary sources of information that we have so far.

1) The District Attorney for Los Angeles County announcing the charges against David.

The charges are:

- First degree murder, with special circumstances.
- Continuous lewd and lascivious sexual acts with an individual under 14 years old.
- Mutilation of human remains (ie, dismembering her body)

The special circumstances are an enhancements to the murder charge. They are:

- Murdering a witness to a crime (ie, Celeste is a witness to her own sexual abuse from David)
- Committing the murder for financial gain
- lying in wait

If found guilty with these special circumstances, David faces either life in prison without parole or the death penalty.

2) The Medical Examiner’s report regarding the autopsy of Celeste Rivas Hernandez.

In short, her cause of death was being stabbed twice: once in the liver and once in between her ribs. The medical examiner also confirmed that she was dismembered post-mortem and her pinky and ring finger on her left hand were never recovered. Though her body was severely decomposed and partially skeletonized, toxicology did not confirm an overdose or that she was pregnant.

3) The District Attorney’s Brief Regarding Preliminary Hearing Evidence.

This document outlines the history between David and Celeste and gives us David’s motive for killing her and provides detail related to the charges. It also previews some of the evidence the prosecutor will use to prove that David is guilty during the trial (date TBD).

I've seen many posts and comments over the months indicating that David's "friends" knew about Celeste Rivas (I say "friends" because I don't believe these people were truly friends, but business collaborators and hangers-on).

However, I have not seen any images or video clips showing her interacting with them or hanging out. I don't think I've even seen anything with her in their presence.

Can you all post some pics or video clips showing Celeste Rivas hanging out together with David's "friends"?

I just wanted to take a moment to point out a few things that may be helpful to some of you as you, like me, are keeping track of the info that has come out about this case.

Sometimes, the media recounts details incorrectly.

Not saying this is done on purpose. A lot of it is someone talking while trying to recall information in the middle of a conversation or interview. Unfortunately, the person will get stuff wrong. Examples:

He watched her bleed out

Harvey Levin on TMZ recounted the detail from the prosecutors brief saying that David “watched” Celeste bleed out. I know this may seem insignificant, but the brief did not say that. It said that he “stood by”. Difference? Saying he watched got people on reddit thinking he filmed it or got his rocks off, or something. Honestly, “stood by” could mean a lot of things, but it can just mean that he coldly monitored the situation to make sure she was dead before he left the house.

Kiddie Pool

I’ve heard Joseph Scott Morgan and maybe a few others call the “blue inflatable pool” mentioned in the brief a “kiddie pool”. To me, when I hear “kiddie pool” I think of a small, shallow wading pool that you put toddlers in (or bathe your dogs in). It wasn’t just about keeping blood off of the garage floor, it was an attempt to contain (in vain) any biological material that would be cast off by the chainsaw.

Dating

The media have said that David and Celeste were “dating” and uses terms like “boyfriend” when describing their relationship. I don’t think this is a conscious effort to normalize sexual predation of minors but sometimes people are a little too economical with their words and aren’t being as careful as they should be (a nice way of saying “lazy”).

He had 40 TB of CSAM

no. That is not what was said by the prosecutor. The prosecutor said they have 40TB of **evidence** and CSAM, as it applies to the charges, is narrow in scope (ie, proof to support the charge of him sexually abusing her). This most likely includes doorbell camera footage, body camera footage and other videos that establish the timelines (like the ones outlined in the brief).

I just wanted to share a few thoughts because…well…it’s a pet peeve of mine.

If I notice or think of any more, then I’ll update this (if I remember).

I’m posting the story to show how the discovery of CSAM on someone’s phone by local law-enforcement led to federal charges for this dude in Michigan.

With that in mind, I think it’s safe to say that the FBI will be investigating David.
