Curious Question About Sen. Bato Dela Rosa's Situation. SC did not issue a TRO but the main case itself is not yet resolved. What happens when one party follows through their interpretation of the law but SC later rules their interpretation (and subsequent action) is incorrect
NAL so I want to understand what is going on so far.
Before today, Government kept deferring Bato's arrest citing they wish to "resolve all legal issues" before they make moves. They tried to avoid directly answering the questions pero as I understood it, their stance is that ICC WoA is valid, it is enforceable and therefore the Senator can be arrested.
And when they said "resolve all legal issues" I understood it to be referring to the TRO petition only and not necessarily the "main case", which the SC specifically emphasized in their official statement, is still pending.
So now the TRO is denied, pero ang main case is not yet resolved.
So say the Government believing they are in the right, follows through and arrests Sen. Bato. Will they be violating any laws in doing so?
Say, Bato was arrested, sent to The Hague but the SC ruled that the Government's interpretation of the law was incorrect. Ano ang mga violations na pwede ikaso sa kanila?
And what remedies can Bato (and by extension Duterte) avail gayong nasa The Hague na sila?
