When the Insureds were sued by Blake Lively in a lawsuit alleging defamation, invasion of privacy, and various other claims, they timely notified Harco and requested that Harco defend them and otherwise honor its duties under the Harco insurance policies.
However, instead of immediately assuming its Insureds’ defense, Harco waited for weeks or longer and then denied coverage, refusing to honor any of its duties. In so acting, Harco breached its duties, including its duties to promptly and thoroughly investigate Ms. Lively’s claims against the Insureds, to immediately assume the Insureds’ defense, and to honor its implied covenant of good faith and fair dealing.
Therefore, Harco is liable for breach of contract and tortious bad faith, and is liable to the Insureds for compensatory and consequential damages.
When life gives you Blake Lively, you add narcissism, an attempt to steal a movie and a lawsuit, and you get TIRED-pool.
