HB 568 was signed into law. Am I reading this correctly that Louisiana medical marijuana patients are exempt while non-patients can face up to a year in jail?

HB 568 has officially been signed into law as Act 305.
I’m trying to understand how this will work in practice.

The bill applies to people who violate R.S. 40:966 through 970 while smoking, vaping, or otherwise consuming cannabis within 2,000 feet of a school, college, school bus, or school-related property.

But R.S. 40:966 also states:
“Any person who is a patient of the state-sponsored medical marijuana program in Louisiana… shall be exempt from the provisions of this Section.”

The penalty section of HB 568 provides for up to one year in jail and a fine.

So if I’m reading this correctly:
Medical marijuana patient = exempt from the underlying statute
Non-patient = potentially subject to the enhanced penalty.

Am I missing something, or is that how the law is written?

Louisiana joined the cannabis rescheduling lawsuit and then withdrew. What changed?

Last week Louisiana joined a lawsuit challenging the federal government’s cannabis rescheduling decision. Now Attorney General Liz Murrill has withdrawn the state from the case.

I’m curious what changed between joining the lawsuit and withdrawing from it a few days later.

Was it legal strategy, political pressure, concerns about Louisiana’s medical cannabis program, or something else?

Louisiana wants a Recreational Cannabis Task Force before fixing the broken medical program?

Louisiana just introduced HCR 111 to create a Recreational Cannabis Policy Task Force to study legalization, taxation, licensing, public health, law enforcement impacts, social equity, and the future of cannabis policy in our state.

On paper, that sounds like progress.

But as a Louisiana medical cannabis patient, I can’t help but ask: why are we rushing to study recreational cannabis when the state still hasn’t fixed the medical program patients already depend on?

Before Louisiana expands cannabis access, maybe we should address the problems patients have been dealing with for years:

• No home grow rights for patients
• Extremely limited cultivators and market competition
• Some of the highest prices in the South
• Lack of affordable access for disabled veterans and low income patients
• No real patient protections for employment, housing, child custody, or firearm rights
• Limited transparency on testing and contamination complaints
• No centralized public database for product recalls or adverse reactions
• Delivery access still limited depending on where you live
• No caregiver expansion for vulnerable patients
• Monopoly concerns with vertically integrated operators dominating production and dispensaries
• Patients still fear stigma, arrest, probation violations, or losing benefits despite being legal under state law

Meanwhile Louisiana politicians are talking about “market caps,” “tax structures,” and “economic development” before many patients can even consistently afford their medicine.

The resolution even says Louisiana wants to avoid the problems other states faced like monopolization and inadequate community reinvestment.

But honestly… aren’t we already dealing with some of those exact issues in the medical program right now?

If this task force actually happens, medical patients, veterans, chronic pain patients, and everyday consumers deserve a seat at the table. Not just law enforcement, industry insiders, and political appointees.

A functional cannabis program should include:

• Affordable medicine
• Independent testing and transparency
• Patient civil rights protections
• Small business opportunities
• Fair licensing
• Home grow options
• Expungement and criminal justice reform
• Social equity that actually means something
• Public health education based on science, not fear

Louisiana has spent years calling medical cannabis “medicine.” If that’s true, then patients should stop being treated like an afterthought.

Curious what everyone else thinks.

Should Louisiana focus on fixing the medical program first before studying recreational legalization?

Louisiana HB539 withdrawn: bill to let bars/restaurants sell hemp THC products is dead for 2026

Louisiana keeps talking about budget shortfalls while simultaneously choking off industries that are already creating jobs, generating tax revenue, and giving adults alternatives to alcohol.

HB539 would have simply allowed new bars and restaurants to legally sell regulated hemp THC products like drinks and gummies. Instead, the bill was withdrawn and Louisiana keeps the same patchwork system where only grandfathered businesses benefit while new local businesses stay locked out.

Meanwhile, since medical cannabis and hemp products became more available in Louisiana, alcohol-related traffic fatalities have trended downward. That doesn’t automatically prove cause and effect, but it does raise an important question: what happens when some adults choose hemp products instead of alcohol?

At some point Louisiana has to decide whether it wants to:
• support local businesses and innovation
• collect tax revenue during a budget crunch
• regulate products responsibly through testing and labeling

or keep pushing consumers toward neighboring states and underground markets.

Adults are already using these products. The conversation now is whether Louisiana wants a safe, regulated market or unnecessary restrictions that mostly hurt local businesses.

▲ 192 r/Louisiana

HB 568 now heads to the Louisiana Senate floor.

This bill would create up to 1 year in jail for smoking or vaping cannabis within 2,000 feet of a school or college.

A lot of people hear that and assume it’s about trafficking, DUI, or smoking directly around children.

It’s not.

The bill specifically targets simple cannabis consumption in a very broad zone that covers entire neighborhoods in many Louisiana cities.

Meanwhile:
• Medical cannabis patients are effectively exempt if compliant with state law
• THC beverages and edibles are not included in the bill
• Maryland treats simple public consumption as a civil offense while reserving harsh penalties for actual trafficking near schools

That’s why many people are questioning whether HB 568 is really about protecting children, or whether it expands criminal penalties for non-violent adults based on legal status and access to the medical program.

The Senate floor vote is scheduled for today.
