US' age of consent in 1880 was 10-12. And a different reading of Aisha's age of consummation
A random line in some article set me off into some research. Here is what I found.
In 1880, across most US states, age of consent (age of protection as they said it then) was 10, 12 etc. This was changed to 16 and 18 by 1920 after some stories about exploitation of young girls went 'viral'.

That led me to asking Gemini about Aisha's age.
So some interpretations clearly say its 9. Relevant portions extracted below:
> Traditional Narratives: The most commonly cited Sahih Bukhari and Sahih Muslim hadiths state that Aisha was 6 years old at the time of her nikah (marriage contract) and 9 years old when the marriage was consummated.
Opposition to this idea:
The scholarly re-evaluation of Aisha’s age is a significant field of study in modern Islamic historiography. Scholars who question the traditional "age 9" narrative generally use internal consistency checks—comparing Aisha’s age to other known historical events and people of the time—to argue she was likely in her late teens.
Here are the four primary arguments used in these re-evaluations:
- Comparison with her sister, Asma This is often considered the strongest historical argument.
The Data: Historical records (such as Siyar A'lam al-Nubala) state that Asma, Aisha’s older sister, was 10 years older than Aisha.
The Math: Records also state that Asma died in the year 73 AH at the age of 100. This means she was 27 or 28 during the Hijra (the migration to Medina in 622 CE).
The Conclusion: If Asma was 27 at the Hijra, Aisha would have been 17. Since the marriage was consummated roughly two years after the Hijra, Aisha would have been 19 years old.
- The Timeline of her Sister's Birth Some scholars point to the biography of Ibn Ishaq, the earliest biographer of the Prophet.
The Data: It is recorded that Aisha’s father, Abu Bakr, had all four of his children during the Jahiliyyah (the pre-Islamic period).
The Math: The Prophet began his mission in 610 CE. If Aisha was born before 610 CE and the marriage was consummated in 623/624 CE, she would have been at least 14 or 15 at the absolute minimum.
- Participation in Battles Early Islamic law and custom generally forbade anyone under the age of 15 from participating in military expeditions.
The Data: Aisha is recorded as having participated in the Battle of Uhud (625 CE) and the Battle of Badr (624 CE) as a nurse and water-carrier.
The Math: If she was only 9 or 10 at this time, she would likely have been barred from the battlefield according to the standards applied to young boys like Ibn Umar, who was famously turned away from Badr for being too young (under 15).
- Language and Translation
Some linguists argue that the Arabic word used for Aisha's age in certain narrations may have been misunderstood over centuries.
In some dialects or shorthand of the time, "nine" might have been a truncated way of saying "nineteen" (dropping the "ten" in common parlance), though this is a more debated linguistic theory than the chronological arguments above.
Why is there a discrepancy?
If these historical clues suggest a later age, why does the "age 9" narration exist in Sahih Bukhari?
Memory and Oral Tradition: These narrations were compiled 150–200 years after the events. While the chain of narrators is respected, some scholars suggest that a single narrator in the chain (often Hisham ibn Urwah) may have misremembered the number in his old age.
Cultural Emphasis: In medieval society, emphasizing a young age was sometimes used to highlight purity or virginity, which was a high social value at the time. It wasn't viewed as "child abuse" then, so there was no social pressure to "increase" the age; if anything, there might have been a symbolic reason to keep it low.
The Modern Scholarly Stance
Today, the debate is split. Traditionalist scholars uphold the "age 9" narration because it appears in the most "authentic" (Sahih) collections. However, modernist and revisionist scholars argue that when the totality of historical evidence (Aisha’s participation in public life, the age of her siblings, and the timeline of the Hijra) is weighed against a single number, the evidence points toward her being a young woman in her late teens.
